In New Mexico, an Albuquerque truck accident claim goes against the motor carrier and its insurer as well as the driver, and fault on your side reduces the recovery but never bars it. Top USA Law preserves the truck's data the day you call. Call (877) 411-5291.

Where Albuquerque truck accidents happen

I-40 is a coast to coast freight route, and Albuquerque is the largest city on its run across the state. Trucks reach the city limits after hours on open highway at speed, and the drivers are tired. I-25 brings a second stream up and down the length of the state, and the two cross at the Big I in the middle of the city. West of the river, truck stops and distribution centers line I-40, and a second cluster of warehouses sits near the airport, so heavy rigs are pulling on and off the interstates at every hour.

The crashes follow that pattern. At the Big I a tractor trailer that has been running at highway speed for hours meets stopped traffic on the ramps and cannot stop in the distance it has. On I-40 west of the river the trouble is trucks entering and leaving the truck stops across full lanes, and on Coors Boulevard and Paseo del Norte it is a rig turning wide across cars at a signal.

The New Mexico State Police, whose commercial enforcement officers also work the ports of entry, respond to most interstate truck crashes, and their inspection findings often explain the crash better than the driver does.

UNM Hospital, the preservation letter and New Mexico's rules

University of New Mexico Hospital on Lomas Boulevard is the state's only Level I trauma center, so the serious truck crash injuries from the Big I and the interstates end up there. Get examined the same day even if you walked away, and tell every provider a commercial truck hit you.

The same day preservation letter

A carrier's rapid response team can have an investigator on the shoulder of I-40 while you are still in the emergency department. The day you retain Top USA Law we send a written demand to the carrier, its insurer and the tow yard to preserve the engine control module data, electronic logging device records, driver facing camera footage, dispatch messages, the driver's qualification and drug testing file, inspection reports and the maintenance history, which can be overwritten within days once the tractor returns to service, and we request the State Police inspection and any port of entry records from that trip.

Who is liable and what New Mexico law requires

The Federal Motor Carrier Safety Regulations limit driving hours and require electronic logs, drug and alcohol testing, driver qualification files and documented inspection and maintenance. A violation is strong evidence of negligence. Beyond the driver, the motor carrier, the trailer owner, the shipper that loaded the freight at a distribution center off I-40 and the contractor that serviced the brakes can each be liable, each with a policy far larger than a private driver's.

New Mexico applies pure comparative negligence under Scott v. Rizzo, so a percentage of fault assigned to you reduces the recovery and never bars it. NMSA 37-1-8 gives three years from the crash to file, and NMSA 41-2-2 gives a family three years from a death under the Wrongful Death Act, NMSA 41-2-1. Suit is filed in the Second Judicial District Court in Bernalillo County. A driver who fled violated NMSA 66-7-201, and intoxication under NMSA 66-8-102 is evidence in the civil case. If a city truck, an ABQ RIDE vehicle or a state highway crew was involved, the Tort Claims Act, NMSA 41-4-16, requires written notice within 90 days and caps what a public entity pays, so we serve it first.

Truck Accidents questions in Albuquerque

Why are truck crashes so common on I-40 and at the Big I?

I-40 is a coast to coast freight route, and trucks reach Albuquerque after hours of open highway with tired drivers at the wheel. At the Big I that traffic meets I-25 and stopped ramp traffic, and a loaded semi cannot stop in time. The truck stops along I-40 add rigs entering and leaving full lanes.

What should the preservation letter cover after an Albuquerque truck accident?

The engine control module download, electronic logging device records, driver facing camera footage, dispatch messages, the driver's qualification and drug testing file, inspection reports and the maintenance history. Top USA Law sends the demand the day you retain the firm, because that data can be overwritten within days.

Which agency writes the crash report for an Albuquerque truck accident?

On I-40 and I-25 it is usually the New Mexico State Police, whose commercial enforcement officers may inspect the truck at the scene. Albuquerque Police cover city streets such as Coors Boulevard, and the Bernalillo County Sheriff covers the unincorporated county. Ask the officer which agency will hold the report.

What if the carrier says I was partly at fault at the Big I?

The claim survives. New Mexico applies pure comparative negligence under Scott v. Rizzo, so a percentage assigned to you reduces the recovery and never ends it. The carrier's insurer builds that percentage from your recorded statement, so route every call through us. The truck's speed and braking data usually answers the argument.

How long do I have to sue after an Albuquerque truck accident?

Three years from the crash under NMSA 37-1-8, or three years from a death under NMSA 41-2-2, filed in the Second Judicial District Court in Bernalillo County. A city, county or state truck requires written notice within 90 days under NMSA 41-4-16. The evidence deadline is days, so call before the tractor moves.

What does an Albuquerque truck accident lawyer cost?

Nothing up front. Top USA Law handles Albuquerque truck cases on a contingency fee, so the consultation is free and there is no attorney fee unless we recover money for you. Case costs, such as data downloads, may apply and are explained in writing before you sign.
