In New York, a Brooklyn crash means no fault coverage pays your medical bills before anyone argues blame, and the driver who caused it answers separately for pain and lost time if the injury is serious. Top USA Law takes Brooklyn claims from the first call. Call (877) 411-5291.

Where Brooklyn car accidents happen

Brooklyn has more residents than any other borough, and its crashes follow the corridors. Atlantic Avenue crosses the whole borough as a truck route with turning traffic at nearly every block, and the stretch through Bedford Stuyvesant and East New York sees some of the city's worst pedestrian and left turn crashes. Flatbush Avenue does the same from the Manhattan Bridge down to Kings Plaza, where the B41 bus, delivery vans and double parked cars compete for two moving lanes.

The Brooklyn Queens Expressway is the borough's highway problem. The triple cantilever under Brooklyn Heights was built for a fraction of today's truck traffic, lanes narrow without warning, and sideswipes and rear end crashes near the Atlantic Avenue and Tillary Street exits are routine. The Belt Parkway along the southern shore is fast, curved and dark, and the stretch between Bay Parkway and Knapp Street produces wrecks late at night.

Ocean Parkway, Kings Highway and Linden Boulevard add wide, fast surface roads through residential neighborhoods where a driver running a stale yellow meets a family in the crosswalk. Whatever the road, the responding NYPD precinct writes the collision report, the first document Top USA Law pulls.

Kings County Hospital, no fault and the courthouse at 360 Adams Street

Kings County Hospital Center on Clarkson Avenue in East Flatbush is the Level I trauma center for the worst crash injuries in central and southern Brooklyn. NYU Langone Hospital Brooklyn in Sunset Park and Brookdale in Brownsville take many others. Those records capture the crash in your own words within hours, and an adjuster reads them first. If you were released at the scene, get examined within two days, or the insurer will argue the pain came from somewhere else.

The no fault claim and the 30 day application

Under New York's no fault system, the insurer of the car you were in, or of the vehicle that struck you if you were walking or cycling, pays medical bills and a share of lost wages regardless of fault, up to the 50,000 dollar basic economic loss limit in Insurance Law 5102. Your application is generally due within 30 days of the crash, and with proof of claim in hand the insurer has 30 days to pay under Insurance Law 5106. If the other driver fled, common on the Belt Parkway at night, VTL 600 makes that a crime and MVAIC can cover a Brooklyn resident without household coverage.

Filing suit in Kings County

Pain and suffering requires a serious injury as defined in Insurance Law 5102(d), which Insurance Law 5104 requires before you can sue the at fault driver: a fracture, significant disfigurement, a permanent or significant limitation, or permanent loss of use. The lawsuit is filed in the Supreme Court of the State of New York, Kings County, at 360 Adams Street, within three years under CPLR 214. For lawsuits filed on or after May 26, 2026, CPLR 1411 applies modified comparative negligence to motor vehicle injury claims, so a pedestrian who crossed mid block on Atlantic Avenue recovers minus their share unless their fault is greater than the other side's combined fault, which can bar the claim. If a New York City Transit bus, an Access-A-Ride vehicle or a City truck was involved, General Municipal Law 50-e requires a notice of claim within 90 days, and a defective notice can end the case.

Car Accidents questions in Brooklyn

Which trauma center handles serious Brooklyn car accident injuries?

Kings County Hospital on Clarkson Avenue in East Flatbush is the Level I trauma center for the borough's worst crash injuries. Brookdale in Brownsville and NYU Langone Hospital Brooklyn in Sunset Park take others. Top USA Law pulls records from either.

Where do I file a Brooklyn car accident lawsuit?

In the Supreme Court of the State of New York, Kings County, at 360 Adams Street near Borough Hall. CPLR 214 gives you three years from the crash to file, though storefront camera video is often overwritten within a few days.

What are the most dangerous roads in Brooklyn for crashes?

Atlantic Avenue, Flatbush Avenue and Linden Boulevard for pedestrian and turning crashes, and the BQE near the Brooklyn Heights cantilever and the Belt Parkway between Bay Parkway and Knapp Street for high speed rear end and sideswipe wrecks, especially at night.

I was hit by a B46 or another MTA bus in Brooklyn. What is different?

New York City Transit is a public authority, so General Municipal Law 50-e requires a notice of claim within 90 days of the crash, far sooner than the three year lawsuit deadline. A defective notice can end an otherwise strong case.

How do I get the police report for my Brooklyn accident?

The responding precinct, the 84th in Downtown Brooklyn or the 75th in East New York, files the collision report, retrievable through the NYPD Collision Report Retrieval Portal. You also owe the DMV an MV-104 within 10 days when anyone is hurt.

How much does a Brooklyn car accident lawyer at Top USA Law cost?

No. The consultation is free and the firm works on contingency, so there is no attorney fee unless it recovers money for you. Costs may apply, explained in writing first. Meetings happen by phone, video, at home or in the hospital.
