In New Jersey, a Newark car accident claim runs on two tracks: your own PIP coverage pays the medical bills from the start, and a separate claim against the driver who hit you covers the rest if your injury qualifies. Top USA Law handles both tracks for Newark crash victims. Call (877) 411-5291 for a free case review.

Where Newark car accidents happen

Newark is where the interstates and the airport meet, and crashes follow the merges. Interstate 78 feeds the New Jersey Turnpike at Exit 14 beside Newark Liberty International Airport, and Routes 1 and 9 run through that tangle carrying port trucks. A driver leaving the airport crosses several lanes in a short distance to reach the Turnpike, and sideswipes and rear end crashes pile up there every week.

Interstate 280 drops the west side of Essex County onto Route 21, McCarter Highway, which runs along the Passaic River past Newark Penn Station and the Prudential Center. The ramps between 280 and McCarter Highway are short and the speed change is sudden, so a car slowing for the ramp is hit by one that has not slowed at all. Event nights at the arena add thousands of cars to streets not built for them.

Downtown, Broad Street and Market Street share their intersections with NJ Transit buses, the Newark Light Rail and delivery trucks, and pedestrians are hit there and on Raymond Boulevard near Penn Station when a turning driver watches for a gap instead of the crosswalk. In the Ironbound, Ferry Street is narrow and double parked, and door strikes there still cause real injuries.

Getting treated at University Hospital in Newark

University Hospital on Bergen Street is a Level I trauma center and where Newark ambulances take serious crashes from the interstates, the airport roads and downtown. Newark Beth Israel Medical Center on Lyons Avenue takes many South Ward injuries. That first emergency room chart is what the insurer reads most closely, because it records what hurt before any lawyer was involved. If the pain only showed up the next morning, get seen that day and say it was from the crash.

The police report and the Essex County courthouse

Newark Police Department officers write the report for crashes on city streets, and you request a copy through the department's records unit. Crashes on the New Jersey Turnpike belong to the New Jersey State Police, so ask the officer at the scene which department will hold it.

A lawsuit over a Newark crash is filed in the Superior Court of New Jersey, Law Division, Essex County, at the Essex County Veterans Courthouse on West Market Street. Essex carries a heavy civil docket, and filing early keeps your case from sitting at the back of the line.

PIP, the verbal threshold and the deadlines

Under N.J.S.A. 39:6A-4, the PIP coverage on your own policy pays your medical bills no matter who caused the crash, up to the limit you chose. Under N.J.S.A. 39:6A-8, drivers who picked the limitation on lawsuit option, the verbal threshold, can only recover for pain and suffering if the injury is a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. We pull your declarations page to check.

Under N.J.S.A. 2A:14-2 you have two years from the crash to file suit. If an NJ Transit bus or a City of Newark vehicle was involved, the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days, and missing it can end the claim. If you share some blame, N.J.S.A. 2A:15-5.1 still lets you recover as long as your share is not greater than the other side's, reduced by your percentage.

Car Accidents questions in Newark

Which hospital treats Newark car accident victims?

University Hospital on Bergen Street is Newark's Level I trauma center and takes serious crashes from the interstates, the airport roads and downtown. Newark Beth Israel on Lyons Avenue takes many South Ward injuries. Top USA Law requests records from whichever hospital saw you.

How do I get the police report for a Newark crash?

If Newark Police responded, request the report through the department's records unit. If the crash was on the New Jersey Turnpike, the New Jersey State Police wrote it and you request it from them. Ask the officer at the scene which department will hold it.

Where is a Newark car accident lawsuit filed?

In the Superior Court of New Jersey, Law Division, Essex County, at the Essex County Veterans Courthouse on West Market Street in downtown Newark. Under N.J.S.A. 2A:14-2 the complaint must be filed within two years of the crash; filing early matters on a busy docket.

I was hit by an NJ Transit bus on Broad Street. Is the claim different?

Yes. NJ Transit is a public entity, so the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days of the crash before any lawsuit. The same rule applies to a City of Newark vehicle. Call early so the notice goes out on time.

Do I have to prove the other driver was fully at fault?

No. Under N.J.S.A. 2A:15-5.1 you can recover as long as your share of fault is not greater than the other side's, reduced by your percentage. At 51 percent or more you recover nothing. On a Route 21 merge, the police report usually decides that split.

What does a Newark car accident lawyer cost?

Top USA Law takes Newark crash cases on a contingency fee. The consultation is free, there is no attorney fee unless the firm recovers money for you, and case costs may apply and are explained in writing before you sign.
