In New Jersey, a truck crash claim starts with your own PIP paying the medical bills, then moves against the motor carrier and every company behind the truck, which carry far larger policies than a car. Top USA Law sends the preservation letter the same day so the truck's data survives. Call (877) 411-5291 for a free case review.

Where Newark truck accidents happen

Newark is the freight gateway for the whole region, and the trucks that serve it never stop. Containers leave Port Newark on Doremus Avenue and Port Street, climb onto Routes 1 and 9 and the Turnpike at Exits 13A and 14, and head west on Interstate 78 toward the warehouse belt. Air cargo leaves the airport's freight buildings on the same roads. A loaded tractor trailer needs the length of a football field to stop from highway speed, and a rear end hit from one is not a fender bender.

The ramps between Interstate 280 and Route 21 are short, and a rig that cannot slow in time runs into the line ahead. The Turnpike's truck lanes between Exit 13A and Exit 14 mix container chassis, fuel tankers and drivers at the end of a long shift. On Doremus Avenue and in the Ironbound's narrow streets, trucks swing wide on turns and cut across bikes, pedestrians and parked cars.

Fatigue, a shifted load, brakes overdue for service, a driver reading a dispatch screen: those causes live in the carrier's records, not the police report, and a Newark truck case is built from those files starting the day you call.

University Hospital, the preservation letter and New Jersey trucking rules

Serious truck crash injuries from the port roads, the Turnpike and Interstate 78 go to University Hospital on Bergen Street, Newark's Level I trauma center. Its charts and imaging become the spine of the claim, so tell every doctor everything that hurts. If you were released at the scene, get examined within a day or two; an injury that first appears a week later is one the insurer will call unrelated.

The same day preservation letter

A trucking company often has an investigator at the scene before the wreck is towed, and the evidence that proves what the driver did can be gone within days: the engine control module that recorded speed and braking, the electronic logging device that shows hours behind the wheel, dash camera footage, the driver qualification file, dispatch messages and the maintenance history. Our first letter demands that every item be preserved, and we ask the court to order it if the carrier refuses.

Who is responsible and the rules that apply

The Federal Motor Carrier Safety Regulations limit driving hours and require electronic logs, hiring checks, drug and alcohol testing and repair records, and a violation is strong evidence of negligence. The driver, the motor carrier, the owner of a leased trailer, the shipper that packed the container, a maintenance shop and sometimes a freight broker can each answer for part of the loss.

Under N.J.S.A. 39:6A-4, your own PIP pays the medical bills first. Whether the carrier owes pain and suffering depends on the verbal threshold under N.J.S.A. 39:6A-8, which serious truck injuries usually clear. Under N.J.S.A. 2A:15-5.1 you recover as long as your share of fault is not greater than the defendants', reduced by your percentage. Suit is filed in Essex County Superior Court at the Veterans Courthouse within two years under N.J.S.A. 2A:14-2, or two years from a death under N.J.S.A. 2A:31-3. If a City of Newark truck, a county vehicle or an NJ Transit bus was involved, N.J.S.A. 59:8-8 requires a written notice of claim within 90 days.

Truck Accidents questions in Newark

Who investigates a truck crash on the Turnpike near Newark Airport?

The New Jersey State Police cover the Turnpike, including the truck lanes at Exits 13A and 14, and the Newark Police Department covers city streets like Doremus Avenue and the Ironbound. Ask the officer which agency holds the report. Top USA Law pulls it and requests any roadside inspection record separately.

What does the preservation letter cover after a Newark truck accident?

It demands that the carrier keep the engine control module download, electronic logging device records, dash camera footage, the driver's qualification and drug testing file, dispatch and delivery records, and the truck's maintenance history. Without the letter, a carrier can overwrite that data under its ordinary retention schedule within days.

Can I sue the trucking company, not just the driver, for a Port Newark crash?

Yes. The motor carrier is responsible for its driver's negligence on the job and can be separately negligent for hiring, training or scheduling. The company that loaded the container, the trailer's owner and a maintenance contractor may also share fault. Each carries its own policy, which is why we identify every party first.

Does the verbal threshold apply to a Newark truck accident?

It depends on the option you selected on your own New Jersey auto policy. Under N.J.S.A. 39:6A-8 the verbal threshold limits pain and suffering to permanent injuries, displaced fractures, significant scarring, loss of a body part and death. Most serious truck injuries clear it, and we pull your declarations page to check.

How long do I have to file a Newark truck accident lawsuit?

Two years from the crash under N.J.S.A. 2A:14-2, filed in Essex County Superior Court at the Veterans Courthouse, or two years from a death under N.J.S.A. 2A:31-3. If a City of Newark truck, a county vehicle or an NJ Transit bus was involved, N.J.S.A. 59:8-8 requires a notice of claim within 90 days.

What does a Newark truck accident lawyer cost?

Nothing up front. Top USA Law takes Newark truck cases on a contingency fee, so the consultation is free and there is no attorney fee unless the firm recovers money for you. Case costs, such as an engine data download, may apply and are explained in writing before you sign.
