In New York, a Queens car accident claim starts with no fault benefits for medical care and lost wages, then a claim against the at fault driver when the injury qualifies as serious. Top USA Law handles Queens crashes from Astoria to the Rockaways. Call (877) 411-5291.

Where Queens car accidents happen

Queens is the borough of wide boulevards, and wide boulevards are where people get hit. Queens Boulevard earned its old nickname: twelve lanes across in places, service roads on both sides, and long crossings at Woodhaven Boulevard, 63rd Drive and Yellowstone Boulevard where a pedestrian must beat two signal cycles. Northern Boulevard through Jackson Heights and Corona is the same story with more bus stops, and Hillside Avenue and Jamaica Avenue see the same left turn and crosswalk crashes farther east.

The highways are worse in a different way. The Van Wyck Expressway between the Kew Gardens Interchange and JFK is a rolling traffic jam of airport taxis, Uber and Lyft cars and cargo trucks, and the interchange itself, where the Van Wyck, the Grand Central Parkway, the Jackie Robinson Parkway and Union Turnpike meet, produces merge and lane change collisions daily. The Long Island Expressway through Maspeth and Rego Park and the Grand Central past LaGuardia are fast, crowded and short on shoulder.

The Cross Island and the Belt Parkway around Howard Beach add night time speed crashes. In every case the responding NYPD precinct files a collision report Top USA Law obtains at the start.

Elmhurst, Jamaica Hospital and the Queens County courthouse

Elmhurst Hospital Center on Broadway, a Level I trauma center, takes serious injuries from western Queens, and Jamaica Hospital Medical Center, also Level I and beside the Van Wyck at 89th Avenue, takes them from the south and east, including crashes near JFK. Top USA Law requests either hospital's records with your signed release. If you refused the ambulance, get seen within two days. Adjusters treat a treatment gap as proof the injury came from elsewhere.

No fault and the application deadline

New York's no fault law means the insurer of the vehicle you were in, or of the vehicle that hit you if you were walking or cycling, pays medical bills and part of lost wages regardless of fault, up to the 50,000 dollar basic economic loss limit set by Insurance Law 5102. The application is generally due within 30 days, and under Insurance Law 5106 the insurer must pay within 30 days of proof of claim. A passenger in a TLC taxi or rideshare headed to LaGuardia claims through that vehicle's insurer. If a driver fled, a crime under VTL 600, MVAIC can cover a Queens resident with no household coverage.

Suing in Queens County

To collect pain and suffering from the at fault driver, the injury must be a serious injury under Insurance Law 5102(d), as Insurance Law 5104 requires: a fracture, significant disfigurement, a significant limitation of a body function, or permanent loss of use. Suit is filed in the Supreme Court of the State of New York, Queens County, at 88-11 Sutphin Boulevard in Jamaica, within three years under CPLR 214. CPLR 1411 reduces a recovery by your share of fault, and for lawsuits filed on or after May 26, 2026, fault greater than the other side's combined fault can bar it, which is why it matters if you crossed Queens Boulevard against the light. When a New York City Transit bus, an MTA Bus Company route, an Access-A-Ride van or a City vehicle is involved, General Municipal Law 50-e requires a notice of claim within 90 days, and a defective notice can end the claim.

Car Accidents questions in Queens

Which hospital treats serious crash injuries in Queens?

Elmhurst Hospital Center on Broadway is the Level I trauma center for western Queens, and Jamaica Hospital Medical Center beside the Van Wyck covers the south and east, including crashes near JFK. Top USA Law requests either's records with your release.

Where is a Queens car accident lawsuit filed?

In the Supreme Court of the State of New York, Queens County, at 88-11 Sutphin Boulevard in Jamaica, a short walk from the Sutphin Boulevard subway and rail stations. CPLR 214 sets a three year deadline from the crash date.

Is Queens Boulevard still dangerous?

Stretches have been redesigned, but the crossings at Woodhaven Boulevard, 63rd Drive and Yellowstone Boulevard still produce pedestrian and turning crashes because of the road's width and service roads. A pedestrian partly at fault can still recover under New York's comparative negligence rule, reduced by their share, unless their fault is greater than the other side's combined fault in a lawsuit filed on or after May 26, 2026.

I was hurt in an Uber or taxi going to JFK or LaGuardia. Who pays?

The taxi or rideshare vehicle's insurer pays your no fault benefits, and TLC licensed vehicles must carry higher liability limits than a private car. As a passenger, your claim runs against that policy and against any other driver at fault.

What if an MTA bus hit me in Queens?

New York City Transit and the MTA Bus Company run Queens buses as public authorities, so General Municipal Law 50-e requires a notice of claim within 90 days. That is a separate, earlier deadline, and a late notice can end the claim.

How do I get the NYPD report for a crash in Queens?

The responding precinct, the 110th in Elmhurst or the 103rd in Jamaica, files the collision report, retrievable through the NYPD Collision Report Retrieval Portal. You must also file an MV-104 with the DMV within 10 days if anyone was injured.
