Where Manhattan car accidents happen

Most Manhattan crashes are low speed and still hurt people. A box truck off the Manhattan Bridge turns onto Canal Street and misses the person in the crosswalk. Six lanes of Williamsburg Bridge traffic pour onto Delancey Street through a neighborhood on foot. Cabs, Uber and Lyft cars and delivery e-bikes fight over the same curb lane, and a passenger door swung into a bike lane is an injury all its own.

The FDR Drive and the West Side Highway are different. Both run at highway speed with little shoulder, so a tap near the FDR's 96th Street exit or a bad lane change on the West Side Highway near 42nd Street becomes a chain collision with nowhere to pull over. The Lincoln Tunnel approaches near 40th Street and Tenth Avenue lock up every weekday evening, and that stop and go traffic produces rear end crashes whose neck pain shows up the next morning.

Uptown, 125th Street and the Harlem River Drive ramps mix buses, cars and people crossing mid block. Whoever hit you, the responding NYPD precinct wrote a collision report, and pulling it early matters because so many Manhattan crashes involve a commercial vehicle.

Bellevue, no fault and the New York County courthouse

Bellevue Hospital on First Avenue at 27th Street is a Level I trauma center and where ambulances take the most serious crash injuries from Midtown and downtown. No fault comes first

New York is a no fault state. The coverage on the car you were in, or on the vehicle that hit you if you were walking or biking, pays medical bills and part of lost wages regardless of fault, up to the basic economic loss limit of 50,000 dollars under Insurance Law 5102. The application is generally due within 30 days of the crash, and Insurance Law 5106 then requires payment within 30 days of proof of claim. If a hit and run driver was never found, MVAIC can step in for a New York resident with no household coverage, and leaving an injury crash is a crime under VTL 600.

Suing the driver in New York County

To recover pain and suffering from the at fault driver, your injury must meet the serious injury threshold in Insurance Law 5102(d), as Insurance Law 5104 requires: a fracture, significant disfigurement, a significant limitation, or permanent loss of use. The lawsuit is filed in the Supreme Court of the State of New York, New York County, at 60 Centre Street on Foley Square, within three years of the crash under CPLR 214. If a pedestrian or cyclist shares blame, CPLR 1411 reduces the recovery by that percentage, and for lawsuits filed on or after May 26, 2026, fault greater than the other side's combined fault can bar it. Faster still: if an MTA bus, an Access-A-Ride van or a City vehicle was involved, General Municipal Law 50-e requires a notice of claim within 90 days, and a late notice can end the case.
