In New York, a Yonkers crash victim gets medical bills and part of lost wages paid by no fault coverage first, then a separate claim against the driver at fault once the injury is serious. Top USA Law handles Yonkers claims by phone, video, at home or at the hospital. Call (877) 411-5291.

Where Yonkers car accidents happen

Yonkers is the largest city in Westchester County, and its crashes follow the old parkways and a few overloaded commercial roads. The Saw Mill River Parkway runs the length of the city with narrow lanes, stone overpasses too low for trucks and almost no shoulder, so a driver who drifts near the Yonkers Avenue or Tuckahoe Road exits ends up in the lane beside them. The Cross County Parkway feeds the Saw Mill, the Bronx River Parkway and I-87 within two miles, and the weave between those ramps by Cross County Center fills with sideswipes and rear end crashes.

The Major Deegan becomes the Thruway at the Bronx line, and the stretch past Yonkers Raceway mixes commuter speed with the trucks the parkways ban. On the surface, Central Park Avenue is a six lane strip of shopping plazas where cars turn across traffic every few hundred feet, and Yonkers Avenue, McLean Avenue and South Broadway through Getty Square see bus, delivery and pedestrian crashes at crowded corners.

On every one of those roads, the Yonkers Police Department, not the NYPD, writes the accident report, and Top USA Law requests it first in every Yonkers claim.

St. John's Riverside, no fault and the courthouse in White Plains

Most Yonkers ambulances go to St. John's Riverside Hospital on North Broadway. The worst injuries go to Westchester Medical Center in Valhalla, the county's Level I trauma center. An adjuster reads that first chart before your own statement, so tell the triage nurse every place that hurts. If you went home from the scene, see a doctor within two days. A gap in treatment is the insurer's favorite argument.

The no fault application and the 30 day deadline

Under New York's no fault law, the insurer of the car you were in, or of the car that hit you if you were on foot, pays your medical bills and part of your lost wages regardless of fault, up to the 50,000 dollar basic economic loss limit in Insurance Law 5102. The application is generally due within 30 days of the crash, and the insurer has 30 days to pay after proof of claim under Insurance Law 5106. If the other driver left the scene, a crime under VTL 600, MVAIC can step in for a Yonkers resident with no household coverage.

Suing in Westchester County

To recover pain and suffering from the driver at fault, your injury must be a serious injury under Insurance Law 5102(d), as Insurance Law 5104 requires: a fracture, significant disfigurement, a permanent or significant limitation of a body function, or permanent loss of use. The case is filed in the Supreme Court of the State of New York, Westchester County, at 111 Dr. Martin Luther King Jr. Boulevard in White Plains, within three years of the crash under CPLR 214. For lawsuits filed on or after May 26, 2026, CPLR 1411 applies modified comparative negligence to motor vehicle injury claims, so a driver who was speeding on the Cross County recovers minus their share unless their fault is greater than the other side's combined fault, which can bar the claim. Bee-Line buses are a Westchester County service, so a crash with one, or with a City of Yonkers vehicle, triggers the 90 day notice of claim under General Municipal Law 50-e.

Car Accidents questions in Yonkers

Which hospital handles serious car accident injuries in Yonkers?

St. John's Riverside Hospital on North Broadway takes most Yonkers ambulance runs. Life threatening injuries go to Westchester Medical Center in Valhalla, the county's Level I trauma center, and some crashes near the Bronx line end up at Jacobi in the Bronx.

Where is a Yonkers car accident lawsuit filed?

In the Supreme Court of the State of New York, Westchester County, at 111 Dr. Martin Luther King Jr. Boulevard in White Plains. CPLR 214 allows three years from the crash to file, but camera footage is often gone within a week.

Which Yonkers roads produce the most crashes?

The Saw Mill River Parkway for narrow lane sideswipes, the Cross County Parkway ramps to the Saw Mill and I-87 for merge and rear end crashes, and Central Park Avenue for left turns across six lanes of shopping plaza traffic all day.

A Bee-Line bus hit my car in Yonkers. Does that change the deadline?

Yes. Bee-Line buses are a Westchester County service, so General Municipal Law 50-e requires a notice of claim within 90 days of the crash, far sooner than the three year lawsuit deadline. City of Yonkers vehicles trigger the same rule.

How do I get the police report for a Yonkers accident?

The Yonkers Police Department, not the NYPD, responds to crashes inside the city and writes the accident report, which your lawyer requests once it is filed. You must also file your MV-104 with the DMV within 10 days if anyone was injured.

What does a Yonkers car accident lawyer at Top USA Law cost?

Nothing up front. The consultation is free and the firm works on contingency, so there is no attorney fee unless it recovers money. Costs may apply, explained in writing first. We meet by phone, video, at home or at the hospital.
