Where Bronx car accidents happen

The Cross Bronx Expressway is congested nearly around the clock, and cuts the borough in half below street level with tight curves, short ramps and constant truck traffic bound for the George Washington Bridge or Throgs Neck. Crashes near the Alexander Hamilton Bridge and the Webster Avenue exit are so common that a rear end collision there barely makes the news, but the whiplash and disc injuries are real.

The Major Deegan along the Harlem River and the Bruckner Expressway through Hunts Point and Soundview carry the same trucks at higher speed, and the Bruckner Interchange, where the Bruckner, the Cross Bronx and the Hutchinson River Parkway meet, sees sideswipes daily. On the surface, the Grand Concourse is the borough's main street and its worst intersection problem: a wide boulevard with service roads, Bx bus routes and turning traffic at 161st Street, Fordham Road and 149th Street where pedestrians get hit.

Fordham Road itself, with the Bx12 Select Bus and shoppers off the curb, and the truck traffic around the Hunts Point Produce Market round out the list. After any of these, the responding NYPD precinct files a collision report that becomes the backbone of the claim.

The Bronx has two Level I trauma centers. Jacobi Medical Center on Pelham Parkway South handles the east and north, and Lincoln Medical Center on East 149th Street takes the South Bronx, the Major Deegan and the lower Grand Concourse. No fault benefits and the 30 day application

The application is generally due within 30 days of the crash, and Insurance Law 5106 requires payment within 30 days of proof of claim. If the driver who hit you on the Cross Bronx kept going, VTL 600 makes that a crime, and a Bronx resident with no household coverage can claim through MVAIC.

Suing the at fault driver in Bronx County

Pain and suffering comes only from the at fault driver, and only if the injury meets the serious injury definition in Insurance Law 5102(d), which Insurance Law 5104 requires: a fracture, significant disfigurement, a permanent or significant limitation, or permanent loss of use. Suit is filed in the Supreme Court of the State of New York, Bronx County, at 851 Grand Concourse at 161st Street, within three years under CPLR 214. For lawsuits filed on or after May 26, 2026, CPLR 1411 applies modified comparative negligence to motor vehicle injury claims, so a pedestrian who stepped off the curb on Fordham Road against the signal recovers minus their share unless their fault is greater than the other side's combined fault, which can bar the claim. If a New York City Transit bus, an Access-A-Ride van or a City truck was involved, General Municipal Law 50-e requires a notice of claim within 90 days, and a late notice can end the case.
