In New York, a truck crash in the Bronx is handled in two parts: no fault coverage pays medical bills and part of lost wages from the start, and the carrier behind the truck answers for the rest when the injury is serious. Top USA Law secures the truck's data before it is overwritten. Call (877) 411-5291.

Where Bronx truck accidents happen

The Bronx is the borough that through freight crosses on its way somewhere else. The Cross Bronx Expressway is the main freight link between the George Washington Bridge and the New England Thruway, and it is jammed, narrow and lined with short ramps. At the Bruckner Interchange it meets the Bruckner Expressway and the roads into Hunts Point, and the Major Deegan runs the west side carrying trucks between its industrial stretches and Manhattan.

Then there is Hunts Point. The Produce Market and the surrounding Food Distribution Center send a steady stream of trucks onto Bruckner Boulevard, the Bruckner Expressway and the local streets of Hunts Point and Longwood, mostly overnight and before dawn. Sheridan Boulevard, converted from the old expressway, carries some of that traffic at surface level, and Webster Avenue adds delivery trucks to bus and pedestrian traffic all day.

The crashes follow the pattern: rear end hits when a tired driver rolls into stopped traffic on the Cross Bronx, sideswipes where a trailer swings across a lane at the Bruckner Interchange, and low speed turning crashes in Hunts Point that pin a pedestrian against a curb. Each one leaves a paper trail inside the carrier, which is where a Bronx truck case begins.

Jacobi, Lincoln, the preservation letter and New York's rules

Serious truck crash injuries in the Bronx go to Jacobi Medical Center on Pelham Parkway or Lincoln Medical Center in Mott Haven, both Level I trauma centers. The trauma chart and imaging from that first day anchor the claim. If you were released at the scene, get examined within a day or two and describe every symptom.

The carrier's rapid response and the preservation letter

A trucking company learns about a Cross Bronx crash within minutes and often has an investigator working before you leave the hospital. We answer with a written preservation demand served immediately, covering the engine control module download, the driver's electronic logs, dash camera footage, the qualification file on the driver, dispatch and delivery records and the maintenance history. That data can be overwritten in days, along with the proof of speed, braking and fatigue.

Who is responsible and the rules that apply

The Federal Motor Carrier Safety Regulations limit driving hours and require electronic logs, drug and alcohol testing, hiring checks, inspections and cargo securement; a violation is strong evidence of negligence. The driver, the motor carrier, the owner of a leased trailer, the wholesaler or shipper that loaded the truck and a maintenance contractor can each be responsible.

No fault pays first. Whether you were in a car or on foot, the applicable no fault coverage pays treatment and part of lost wages up to the Insurance Law 5102 limit, the application is generally due within 30 days, and Insurance Law 5106 makes benefits payable within 30 days of proof. Pain and suffering from the carrier depends on a serious injury under Insurance Law 5102(d), which Insurance Law 5104 requires before suit. Your own share of fault reduces the claim under CPLR 1411, and for lawsuits filed on or after May 26, 2026, fault greater than the other side's combined fault can bar it. The lawsuit is filed in the Supreme Court, Bronx County, at 851 Grand Concourse within three years under CPLR 214, or two years of a death under EPTL 5-4.1. A Sanitation truck, another City vehicle or a New York City Transit bus means General Municipal Law 50-e and its 90 day notice of claim.

Truck Accidents questions in The Bronx

Which roads in the Bronx see the most truck crashes?

The Cross Bronx Expressway, the Bruckner Expressway and the Bruckner Interchange, the Major Deegan, and the streets around the Hunts Point Produce Market and Food Distribution Center, including Bruckner Boulevard. Through freight and overnight produce deliveries put heavy trucks on narrow, congested roads beside local traffic, pedestrians and cyclists.

What does the preservation letter cover after a Bronx truck accident?

Everything that shows how the truck was driven and maintained: the engine control module download, the driver's electronic logs, any dash camera footage, the qualification and testing file on the driver, dispatch and delivery records and the maintenance history. Top USA Law serves it as soon as you retain the firm, before routine overwriting erases it.

Who is responsible for a crash with a Hunts Point delivery truck?

Potentially the driver, the motor carrier, the owner of a leased trailer, the wholesaler or shipper that loaded the truck and any contractor that maintained it. The Federal Motor Carrier Safety Regulations set duties for each, and a violation is strong evidence of negligence. Each party carries its own insurance.

Do I have to prove a serious injury after a truck accident in the Bronx?

For pain and suffering, yes. Insurance Law 5104 requires a serious injury as Insurance Law 5102(d) defines it: a fracture, significant disfigurement, a permanent or significant limitation. Most truck crash injuries meet it. Medical bills and lost wages are paid by no fault either way, within 30 days of proof under Insurance Law 5106.

How long do I have to sue after a truck crash in the Bronx?

CPLR 214 gives three years from the crash to file in the Supreme Court, Bronx County, at 851 Grand Concourse, and EPTL 5-4.1 gives two years from a death. A Sanitation truck, another City vehicle or a New York City Transit bus cuts that to a 90 day notice of claim under General Municipal Law 50-e.

What does a Bronx truck accident lawyer at Top USA Law cost?

Nothing up front. The consultation is free, and Top USA Law's fee comes only out of a recovery; with no recovery there is no attorney fee. Case costs, including data downloads and reconstruction experts, may apply and are explained in writing. We come to you by phone, video, home or hospital visit.
