In New York, a Manhattan truck crash claim runs on two tracks: no fault coverage pays the hospital and part of your wages within weeks, and the trucking company pays for the lasting harm once the injury is serious. Top USA Law locks down the truck's electronic records before they disappear. Call (877) 411-5291.

Where Manhattan truck accidents happen

Manhattan bans trucks from the FDR Drive, the Harlem River Drive and the parkways, so every tractor trailer and box truck bound for the island is squeezed onto a short list of streets: Route 9A along the West Side below 57th Street, Canal Street between the Holland Tunnel and the Manhattan Bridge, Delancey Street off the Williamsburg Bridge, the Lincoln Tunnel approaches and 125th Street across Harlem. At the north end, trucks leaving the George Washington Bridge and the Cross Bronx Expressway come down Amsterdam Avenue and Broadway through Washington Heights.

The crashes follow the freight. A rig turning off Canal Street cuts across a crosswalk. Produce trucks from the Hunts Point market cross the Harlem River bridges before dawn and roll into East Harlem on First Avenue and Lexington Avenue. Box trucks and private garbage trucks work the narrow crosstown streets overnight, backing into loading zones without a spotter, and the docks around Hudson Yards and the Javits Center put semis and pedestrians on the same curb.

Whether the cause was a driver past the hours limit, worn brakes or a shifted load, the proof sits in the trucking company's own systems, and the case turns on reaching those records before the carrier decides what survives.

Bellevue, Weill Cornell, the preservation letter and New York's rules

A serious truck injury in Manhattan usually means Bellevue Hospital on First Avenue or NewYork-Presbyterian Weill Cornell on East 68th Street, the island's Level I trauma centers, or Harlem Hospital for crashes uptown. That first chart is the baseline every insurer measures against; if the pain came later, get examined within a day or two and mention the truck.

Sending the preservation letter before the carrier cleans house

A carrier treats a crash on Canal Street as litigation from the first call and often has an investigator at the scene first. We answer with a written preservation demand covering the engine control module download, the electronic logging device that tracks the driver's hours, any cab camera, the driver's qualification and drug testing file, dispatch messages and the maintenance log. Much of it is overwritten within days.

Who answers for the crash and what New York law says

The Federal Motor Carrier Safety Regulations set the hours a driver may work and require electronic logs, testing, inspections and repair records; a violation is powerful proof of negligence. The driver, the motor carrier, a separate trailer owner, the shipper that loaded the cargo and a maintenance vendor can all be defendants.

No fault coverage on the vehicle you were in, or on the truck if you were on foot or a bike, pays medical bills and part of lost wages up to the Insurance Law 5102 limit; the application is generally due in 30 days and payment 30 days after proof under Insurance Law 5106. To recover pain and suffering from the carrier, Insurance Law 5104 requires a serious injury as Insurance Law 5102(d) defines it, which truck injuries rarely miss. Blame on your side reduces the award under CPLR 1411, and for lawsuits filed on or after May 26, 2026, fault greater than the other side's combined fault can bar it. The case is filed in the Supreme Court, New York County, at 60 Centre Street within three years of the crash under CPLR 214, or within two years of a death under EPTL 5-4.1. A Department of Sanitation truck or a New York City Transit bus brings General Municipal Law 50-e into play: 90 days to serve a notice of claim.

Truck Accidents questions in Manhattan

Why are Manhattan truck crashes concentrated on Canal Street and the West Side Highway?

Trucks are banned from the FDR Drive, the Harlem River Drive and the parkways, so commercial traffic funnels onto Route 9A below 57th Street, Canal Street, the tunnel approaches and 125th Street. Those streets mix tractor trailers with the city's densest foot and bicycle traffic, and a wide turn across a crosswalk is the typical serious crash.

What records should be preserved after a Manhattan truck accident?

The engine control module download, the electronic logging device data on the driver's hours, any cab camera, the driver's qualification and drug testing file, dispatch messages and the maintenance log. Top USA Law sends a written preservation demand to the carrier right away because those systems overwrite themselves within days.

Do I need a serious injury to sue the trucking company in Manhattan?

For pain and suffering, yes. Insurance Law 5104 requires a serious injury as defined in Insurance Law 5102(d), such as a fracture, significant disfigurement or a significant limitation. Truck crash injuries almost always qualify, and no fault benefits for medical bills and lost wages are paid regardless.

A Sanitation truck hit me on a Manhattan street. Is the deadline different?

Yes. A Department of Sanitation truck is a City vehicle, and General Municipal Law 50-e sets a 90 day deadline for a notice of claim; the same rule covers a New York City Transit bus. The notice has strict content and service requirements, so call a lawyer before the window closes.

Where is a Manhattan truck accident lawsuit filed and how long do I have?

In the Supreme Court, New York County, at 60 Centre Street. The deadline is three years from the crash under CPLR 214, or two years from a death under EPTL 5-4.1. Still, camera footage and the truck's data can be gone within weeks unless a preservation letter goes out.

What does it cost to hire Top USA Law for a Manhattan truck accident?

The consultation is free and the firm is paid a percentage of the recovery, so there is no attorney fee unless we win. Case costs may apply and are explained in writing first. We meet clients by phone, video, at home or at the hospital.
