In New York, a Brooklyn truck crash is paid in two pieces: no fault coverage handles medical bills and part of lost wages right away, and the trucking company answers for the rest when the injury is serious. Top USA Law preserves the truck's data before the carrier can erase it. Call (877) 411-5291.
Brooklyn's parkways ban trucks, so every tractor trailer, box truck and container chassis serving the borough shares a handful of roads. With the Belt Parkway and Ocean Parkway off limits, freight moves on the Brooklyn Queens Expressway and the Gowanus Expressway, then onto the City's designated truck routes: Atlantic Avenue, Flatbush Avenue, Linden Boulevard, Hamilton Avenue and the streets that feed the Red Hook container terminal, the Sunset Park waterfront around Industry City and the Brooklyn Navy Yard.
Those are the roads where trucks meet people. The BQE's narrow lanes and short exits under Brooklyn Heights produce sideswipes and underride crashes when a rig changes lanes without room. Hamilton Avenue under the Gowanus carries port trucks past cyclists and pedestrians at every cross street. Atlantic Avenue's turning traffic and Linden Boulevard's speed put delivery drivers on tight schedules next to family cars, and a truck making a wide right turn across a crosswalk is one of the borough's most common serious injury crashes.
A driver past the hours limit, brakes out of adjustment, a shifted load, a tablet showing the next stop: these causes sit in the carrier's own systems, and a Brooklyn truck case is won by reaching them before the company decides what to keep.
Serious truck crash injuries in Brooklyn go to Kings County Hospital Center on Clarkson Avenue, the borough's Level I trauma center; NYU Langone Hospital Brooklyn in Sunset Park takes many from the waterfront and the Gowanus. Those first records fix the injury in time. If you left the scene on your own, see a doctor within a day or two and describe the crash.
Trucking companies move fast after a Brooklyn crash, often with an investigator on the BQE before the vehicles are cleared. Our first step is a written demand that the carrier preserve the engine control module data, the electronic logging device records, dash camera footage, the driver qualification file, dispatch and delivery records and the maintenance history. Most of it can be overwritten within days, and it shows what the driver actually did.
The Federal Motor Carrier Safety Regulations limit driving hours and require electronic logs, drug and alcohol testing, hiring checks and repair records; a violation is strong evidence of negligence. Beyond the driver, the motor carrier, the owner of a leased trailer, the company that loaded the cargo and a maintenance contractor may each be responsible.
Under New York's no fault law, the coverage on the vehicle you were in, or on the truck if you were walking or cycling, pays medical bills and part of lost wages up to the limit in Insurance Law 5102; the application is generally due within 30 days and payment within 30 days of proof under Insurance Law 5106. Pain and suffering against the carrier requires a serious injury under Insurance Law 5102(d), as Insurance Law 5104 requires, which most truck injuries meet. Fault is compared under CPLR 1411, and for lawsuits filed on or after May 26, 2026, fault greater than the other side's combined fault can bar recovery. Suit is filed in the Supreme Court, Kings County, at 360 Adams Street within three years under CPLR 214, or two years of a death under EPTL 5-4.1. If a Sanitation truck, another City vehicle or a New York City Transit bus was involved, General Municipal Law 50-e requires a notice of claim within 90 days.
