Where Jersey City car accidents happen

Jersey City sits between the Holland Tunnel and the Turnpike Extension, and many of its crashes are drivers passing through in a hurry. The tunnel approaches on Route 139 and along Twelfth and Fourteenth Streets back up for blocks every evening, and rear end hits happen when the line lurches forward and stops again. The Pulaski Skyway, carrying Routes 1 and 9 over the meadows, has no shoulders, so a single tap becomes a chain collision with nowhere to pull off.

Route 440 along the west side is a divided highway with retail driveways and jug handles, and the crossings at Communipaw Avenue and near the Hudson Mall see left turn and red light crashes. Kennedy Boulevard runs the length of the city through Journal Square, four lanes of buses, taxis and double parked cars, and the Boulevard is where many of the city's pedestrian injuries happen.

Grand Street, Marin Boulevard and Washington Boulevard carry cars around the Hudson Bergen Light Rail, and drivers turning across the tracks or stopping short at a crossing gate get hit from behind. Cyclists on the Grove Street and Newport blocks are doored by ride share drivers pulling to the curb near the PATH stations.

Jersey City Medical Center on Grand Street is a Level II trauma center and the hospital city ambulances use for serious crashes from the Skyway, Route 440 and the tunnel approaches. What matters is that the first record of the injury is dated the day of the crash, because the adjuster reads that emergency room note first. If you woke up stiff the next day, go in that day and say it was a car crash.

Police reports and filing in Hudson County

The Jersey City Police Department writes the report for crashes on city streets, Kennedy Boulevard and Route 440, and copies come from the department's records bureau. If the collision was on the Turnpike Extension, the New Jersey State Police hold the report.

PIP, the lawsuit threshold and the 90 day rule

The lawsuit has to be filed within two years of the crash under N.J.S.A. 2A:14-2. If an NJ Transit bus, a light rail vehicle or a City of Jersey City vehicle was involved, the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days, and missing that notice can end the case. Fault is split under N.J.S.A. 2A:15-5.1: you can recover if your share is not greater than the other side's, and a driver found 51 percent or more at fault recovers nothing.
