In New Jersey, a Bayonne car accident claim starts with the PIP coverage on your own policy, which pays the hospital and follow up care whoever was at fault, and continues with a claim against the other driver for everything else if your injury qualifies. Top USA Law runs both. Call (877) 411-5291.

Bayonne crashes: Route 440, Broadway and the bridge approach

Bayonne is a long, narrow peninsula with three roads running its length and numbered streets cutting across them. Route 440 carries the through traffic between the Bayonne Bridge and the Jersey City line, with shopping center driveways and signals interrupting what drivers treat as a highway. The stretch by the Bayonne Crossing shops sees rear end crashes when a car brakes for a turning truck the driver behind never expected to stop.

Broadway is the main street, and its crashes are slower but no less damaging: a car nosing out of a parking space, a delivery truck double parked at 22nd Street, a pedestrian walking toward the 34th Street light rail station. Kennedy Boulevard and Avenue C carry the rest of the local traffic, and the numbered street intersections along them produce the T-bone collisions that hurt people on the passenger side.

The bridge approach on Route 440 and the Turnpike Extension at Exit 14A funnel port trucks and commuters through the same lanes, and the Hudson Bergen Light Rail crosses city streets at grade, so a driver who goes around the gates or turns in front of a train is a Bayonne specific case. Where it happened decides who investigates.

Bayonne Medical Center, Jersey City Medical Center and the county court

Bayonne Medical Center on East 29th Street is the hospital in town, and most Bayonne ambulances go there. Serious trauma goes north to Jersey City Medical Center, the Level II trauma center for Hudson County. That first emergency room record is the document an adjuster trusts most, because it was written before any claim existed. If you drove home and woke up unable to turn your neck, go in that morning and say the crash caused it.

Who writes the report and where the case is filed

The Bayonne Police Department handles crashes on Broadway, Kennedy Boulevard, Avenue C and Route 440 inside the city. A crash on the Turnpike Extension is a New Jersey State Police report. A lawsuit is filed in the Superior Court of New Jersey, Law Division, Hudson County, at the William J. Brennan Courthouse on Newark Avenue in Jersey City.

PIP, the lawsuit threshold and two clocks

Under N.J.S.A. 39:6A-4 your own PIP pays medical bills up to your selected limit regardless of fault. Pain and suffering is a separate question under N.J.S.A. 39:6A-8: if your policy carries the limitation on lawsuit option, the injury must be a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. Drivers with the unlimited option have no threshold. We check your declarations page.

The first clock is N.J.S.A. 2A:14-2, which gives you two years from the crash to file suit. The second is shorter. If an NJ Transit bus, the light rail, a city, county or State vehicle was involved, N.J.S.A. 59:8-8 requires a written notice of claim within 90 days, and missing it can end the case. Under N.J.S.A. 2A:15-5.1, shared fault reduces your recovery by your percentage, and at 51 percent or more there is none.

Car Accidents questions in Bayonne

Where are Bayonne crash victims treated?

Most Bayonne ambulances go to Bayonne Medical Center on East 29th Street. Serious trauma goes to Jersey City Medical Center, the Level II trauma center for Hudson County. Top USA Law requests records from either hospital, and from any follow up care.

How do I get the police report for a Bayonne accident?

Ask the Bayonne Police Department records bureau, usually a few days after the crash. Crashes on the Turnpike Extension near Exit 14A are New Jersey State Police reports and come from the State Police instead. We pull the report for every client.

Where is a Bayonne car accident lawsuit filed?

In the Superior Court of New Jersey, Law Division, Hudson County, at the William J. Brennan Courthouse on Newark Avenue in Jersey City. Under N.J.S.A. 2A:14-2 the complaint must be filed within two years of the crash, and settlement talks usually start well before then.

A light rail train hit my car at a crossing. Is that a normal claim?

No. The Hudson Bergen Light Rail is an NJ Transit line, so the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days of the crash. The same rule covers NJ Transit buses and City of Bayonne vehicles. Call early.

The other driver says I cut him off on Route 440. Can I still recover?

Possibly. Under N.J.S.A. 2A:15-5.1 you can recover as long as your share of fault is not greater than the other side's, reduced by your percentage. At 51 percent or more you recover nothing. Shopping center cameras along Route 440 often settle that argument.

How much does a Bayonne car accident lawyer cost?

There is no fee to start. Top USA Law takes Bayonne cases on contingency, so you owe no attorney fee unless the firm recovers money for you. Case costs may apply, and they are set out in writing before you sign anything.
