In New Jersey, your own auto policy pays the medical bills after a Clifton crash, and a separate claim against the driver who hit you covers pain and suffering and the rest, if your injury qualifies. Top USA Law opens both claims for Clifton drivers, passengers and pedestrians. Free case review at (877) 411-5291.

Clifton crash spots: Route 3, Route 46 and the Parkway

Clifton sits where three highways braid together. Route 3, Route 46 and the Garden State Parkway cross one another in the Allwood section within about a mile, on ramps that are short, curved and fed from both sides. A driver coming off the Parkway onto Route 3 toward the Lincoln Tunnel has to merge into traffic already at highway speed, and sideswipes and rear end crashes follow. Allwood Road, passing under Route 3 by the Styertowne shops, backs up onto those ramps at rush hour.

Route 21 runs the eastern edge of the city along the Passaic River, mixing trucks and commuters on tight ramps near Botany Village. Main Avenue and Clifton Avenue carry the local traffic, with NJ Transit buses stopping every few blocks, parked cars on both curbs and shoppers crossing mid block. A left turn off Main Avenue into the path of a bus pulling out is a very Clifton crash.

Whichever road it was, the questions are the same: who had the right of way, what the officer wrote, and how quickly you saw a doctor. Many drivers on Clifton's highways are just passing through, so the crash report becomes the document every insurer leans on.

Treatment at St. Joseph's in Paterson or St. Mary's in Passaic

Serious Clifton crashes go by ambulance to St. Joseph's University Medical Center in Paterson, the Level II trauma center for Passaic County. Lesser injuries often end up at St. Mary's General Hospital in Passaic, minutes from the Clifton line. That first chart matters most, because the insurer reads it to see what you reported before anyone was thinking about a claim. If the pain arrived the next morning, get seen that day and say it began with the crash.

Crash reports and the Passaic County courthouse

The Clifton Police Department writes the report for crashes on city streets and on Route 3 and Route 46 inside the city; a Garden State Parkway crash is a New Jersey State Police report. A lawsuit is filed in the Superior Court of New Jersey, Law Division, Passaic County, at the courthouse on Hamilton Street in Paterson.

PIP, the verbal threshold and two deadlines

Under N.J.S.A. 39:6A-4, the PIP coverage on your own policy pays your medical bills regardless of who caused the crash, up to the limit you selected. Whether you can also sue for pain and suffering depends on N.J.S.A. 39:6A-8: with the limitation on lawsuit option, the injury has to be a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. Your declarations page shows which option you have.

The lawsuit deadline under N.J.S.A. 2A:14-2 is two years from the crash. If an NJ Transit bus, a Clifton city vehicle, a county truck or a State vehicle was involved, N.J.S.A. 59:8-8 requires a written notice of claim within 90 days, and missing it can end the claim. Under N.J.S.A. 2A:15-5.1 you can still recover if your share of fault is not greater than the other side's, reduced by your percentage; at 51 percent or more you recover nothing.

Car Accidents questions in Clifton

Where do Clifton crash victims get treated?

Serious injuries go to St. Joseph's University Medical Center in Paterson, the Level II trauma center for Passaic County. Less severe injuries are often seen at St. Mary's General Hospital in Passaic. Top USA Law requests the records from whichever hospital treated you.

Who has the police report for my Clifton accident?

Clifton Police for crashes on city streets and on Route 3 or Route 46 inside the city. The New Jersey State Police handle the Garden State Parkway. Ask the responding officer which department holds it, then request it through that department's records unit.

Where is a Clifton car accident lawsuit filed?

In the Superior Court of New Jersey, Law Division, Passaic County, at the courthouse on Hamilton Street in Paterson. Under N.J.S.A. 2A:14-2 the complaint has to be filed within two years of the crash, and the case is worked up well before that.

An NJ Transit bus hit me on Main Avenue. What changes?

NJ Transit is a public entity, so the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days of the crash. The same rule applies to a Clifton city vehicle or a Passaic County truck. Missing that notice can end the claim.

Can I still recover if I was partly at fault on the Route 3 ramp?

Yes. Under N.J.S.A. 2A:15-5.1 you can recover as long as your share of fault is not greater than the other side's, and your award is reduced by your percentage. At 51 percent or more you get nothing, so the report and any dashcam footage matter.

What will a Clifton car accident lawyer cost me?

Nothing to start. Top USA Law offers a free consultation and works on contingency, so there is no attorney fee unless the firm recovers money for you. Case costs may apply, and they are explained in writing before you sign anything.
