Las Cruces sits where I-10 and I-25 meet, and the interchange on the south side of the city is where the worst crashes happen. I-10 carries a steady line of trucks moving freight to and from the Santa Teresa port of entry, and a car merging into that traffic from the ramps has little room for error. When a loaded trailer is involved, the injuries are rarely minor.
US 70 climbs out of the city toward the mountains and the missile range gate, and the morning and evening runs of workers on that highway produce high speed rear end and crossover crashes. In town, Lohman Avenue and Telshor Boulevard carry the shopping traffic near the mall through a chain of signals, and left turns across those lanes are the most common cause of T-bone collisions. Main Street downtown and El Paseo Road near the university mix students, buses, cyclists and people on foot, and Valley Drive on the west side runs long stretches between lights.
Whatever the road, the claim turns on fault, insurance and the extent of your injuries. Each is written down first by a hospital and a police officer, and getting those records right early is most of the work.
MountainView Regional Medical Center on East Lohman Avenue and Memorial Medical Center on Telshor Boulevard treat most Las Cruces crash victims, and the most severe injuries are flown or driven to University of New Mexico Hospital in Albuquerque, the state's only Level I trauma center. New Mexico has no personal injury protection, so no policy pays your bills as they arrive. Health insurance or Medicaid covers treatment, and medical payments coverage on your auto policy, if you carry it, pays a set amount regardless of fault. The claim against the at fault driver's liability policy then repays those costs with lost wages and pain and suffering. Because many Dona Ana County drivers have no insurance or the bare minimum, your own uninsured and underinsured motorist coverage, or a household member's, may be the policy that actually pays. Being partly at fault does not end the claim. Under Scott v. Rizzo, New Mexico applies pure comparative negligence: a person found 25 percent responsible still recovers 75 percent. Those percentages are argued, so do not give the other insurer a recorded statement first.
A lawsuit is filed in the Third Judicial District Court in Dona Ana County in Las Cruces. NMSA 37-1-8 allows three years from the crash to file, and NMSA 41-2-2 allows three years from a death under the Wrongful Death Act, NMSA 41-2-1. If a RoadRUNNER Transit bus or a city or county vehicle was involved, the Tort Claims Act, NMSA 41-4-16, requires written notice within 90 days and caps what a public entity pays.
