In New Jersey, the medical bills from an Edison crash are paid first by your own PIP coverage, no matter who caused it, and the claim against the driver at fault covers pain and other losses if the injury qualifies. Top USA Law handles Edison cases. Reach us at (877) 411-5291.

Where Edison car accidents happen

Edison is a township of highways. Route 1 runs through the middle past Menlo Park Mall, where mall traffic enters and leaves through jughandles and crossovers that out of town drivers do not expect, and rear end and left turn crashes there are constant. Interstate 287 begins at Turnpike Exit 10 and climbs north through the township, and its interchange with Route 1 sends drivers weaving across lanes to reach the right ramp.

Route 27, the old Lincoln Highway, is the slower road, lined with shops and homes and crossed by Amboy Avenue and the streets around the Edison train station, where left turns across oncoming traffic cause many of the injury crashes. Woodbridge Avenue carries tractor trailers in and out of Raritan Center at the south end of the township, and a car meeting a loaded truck loses every time.

Oak Tree Road near the Iselin border is different again: dense storefronts, restaurant and banquet traffic in the evenings, cars pulling in and out of tight lots, shoppers crossing between stores. A crash there is usually low speed, but the injuries to a pedestrian or a rear seat passenger are real. Where it happened is the first thing we ask.

JFK University Medical Center, Robert Wood Johnson and the Middlesex court

JFK University Medical Center on James Street in Edison takes most crash injuries from the township. Severe trauma goes to Robert Wood Johnson University Hospital in New Brunswick, the Level I trauma center. That first emergency record, taken before you talked to any insurer, becomes the baseline for the whole claim. If symptoms surfaced a day or two later, go to JFK or your own doctor and say the crash is the reason.

Reports from Edison Police and filing in New Brunswick

The Edison Police Department writes the report for crashes on Route 1, Route 27, Oak Tree Road and the local streets. A crash on the New Jersey Turnpike belongs to the State Police, so ask the officer which department will have it. A lawsuit is filed in the Superior Court of New Jersey, Law Division, Middlesex County, at the courthouse on Paterson Street in New Brunswick.

PIP, the verbal threshold and the deadlines

Under N.J.S.A. 39:6A-4, PIP on your own auto policy pays your medical bills regardless of fault, up to the limit you chose. Whether you can also recover for pain and suffering turns on N.J.S.A. 39:6A-8. With the limitation on lawsuit option, the injury has to be a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. Few people remember which box they checked, so we read the declarations page.

A lawsuit must be filed within two years of the crash under N.J.S.A. 2A:14-2. When an NJ Transit bus, a township, county or State vehicle was involved, N.J.S.A. 59:8-8 requires a written notice of claim within 90 days, and the claim can be lost without it. Under N.J.S.A. 2A:15-5.1 your recovery is reduced by any fault assigned to you, and 51 percent or more ends it.

Car Accidents questions in Edison

Which hospital handles Edison car accident injuries?

JFK University Medical Center on James Street in Edison sees most crash injuries from the township. Severe trauma goes to Robert Wood Johnson University Hospital in New Brunswick, the Level I trauma center. Top USA Law requests records from whichever one treated you.

How do I get my Edison police report?

Request it from the Edison Police Department records unit a few days after the crash. If the crash was on the New Jersey Turnpike, the State Police wrote the report and hold it. The responding officer can tell you which department to ask.

Where is an Edison car accident lawsuit filed?

In the Superior Court of New Jersey, Law Division, Middlesex County, at the courthouse on Paterson Street in New Brunswick. Under N.J.S.A. 2A:14-2 you have two years from the crash to file, and the case is investigated and negotiated long before that deadline arrives.

Does the two year deadline apply if an NJ Transit bus hit me on Route 27?

Two years is the lawsuit deadline, but NJ Transit is a public entity, so N.J.S.A. 59:8-8 also requires a written notice of claim within 90 days of the crash. The same applies to a township or county vehicle. A missed notice can end the claim.

The insurer says I was partly at fault on the Route 1 jughandle. Do I lose?

Not necessarily. Under N.J.S.A. 2A:15-5.1 you can still recover as long as your share of fault is not greater than the other side's, with your award reduced by that share. At 51 percent or more you recover nothing, so the report and any video matter.

What does Top USA Law charge for an Edison case?

The consultation is free, and there is no attorney fee unless the firm recovers money for you. Case costs may apply and are explained in writing before you sign. You pay nothing to find out whether your Edison crash is worth pursuing.
