In New Jersey, a Woodbridge crash claim begins with your own PIP coverage, which pays the doctors regardless of fault, and continues with a claim against the driver who caused it for pain and everything PIP did not cover, if the injury qualifies. Top USA Law takes Woodbridge cases. Phone (877) 411-5291.
Woodbridge Township is where the Turnpike, the Garden State Parkway and Routes 1 and 9 all meet, and the Exit 11 interchange is why so many crash reports here name drivers just passing through. Traffic leaving the Turnpike splits toward the Parkway and Route 9 within a few hundred yards, and drivers who change their minds late cause the sideswipes and rollovers.
Route 1 through Iselin is a strip of dealerships, plazas and jughandles, and Woodbridge Center Drive empties mall traffic onto Route 35 and Route 1 at signals that back up onto the highway on weekends. Route 35 south through Sewaren and Route 440 past Keasbey and Hopelawn carry heavy trucks, and a car caught between two of them at a light has nowhere to go.
Main Street downtown and Amboy Avenue through Fords are local roads with local crashes: a car pulling out of a side street, a pedestrian crossing near the Woodbridge train station, a rear end at the light. NJ Transit's North Jersey Coast Line runs through Avenel and Woodbridge, and the station streets fill with buses, taxis and hurried drivers at rush hour. Where you were hurt changes who wrote the report.
Woodbridge has no hospital of its own, so ambulances go to JFK University Medical Center in Edison, or from the southern sections to Raritan Bay Medical Center in Perth Amboy. The most serious injuries go to Robert Wood Johnson University Hospital in New Brunswick, the Level I trauma center. Adjusters read that first chart line by line, and delay is used against you. If the pain showed up at home, see a doctor that day and tie it to the crash.
Woodbridge Police cover Route 1, Route 35, Main Street, Amboy Avenue and the township streets. The New Jersey State Police patrol the Turnpike and the Garden State Parkway and hold those reports. A lawsuit is filed in the Superior Court of New Jersey, Law Division, Middlesex County, at the courthouse on Paterson Street in New Brunswick.
Under N.J.S.A. 39:6A-4, the PIP coverage on your own policy pays your medical bills regardless of fault, up to the limit you picked. Under N.J.S.A. 39:6A-8, if your policy has the limitation on lawsuit option, you can sue for pain and suffering only for a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. The unlimited option has no threshold. Your declarations page has the answer, and we pull it.
N.J.S.A. 2A:14-2 gives you two years from the crash to file suit. If an NJ Transit bus or train, a township, county or State vehicle was involved, N.J.S.A. 59:8-8 requires a written notice of claim within 90 days, and a late notice can end the claim. Under N.J.S.A. 2A:15-5.1, your recovery is cut by your share of fault, and 51 percent or more means no recovery.
