In New Jersey, your own auto policy pays the medical bills after a Cherry Hill car accident through PIP, whoever was at fault, and a separate claim against the driver who hit you covers what PIP leaves out. Top USA Law takes Cherry Hill cases by phone, video, at home or at the hospital. Call (877) 411-5291.
Cherry Hill is a township of wide arterial roads lined with shopping centers, and the crashes follow the driveways. Route 38 and Route 70 run roughly parallel across the township with a curb cut every few hundred feet, and the stretch of Route 38 by the Cherry Hill Mall and Haddonfield Road is where much of the trouble happens. A driver turning left out of the mall across three lanes, or braking hard for a jughandle while the car behind reads a sign, produces the rear end and angle crashes Cherry Hill Police see most.
Kings Highway, which is Route 41, crosses both of those roads and meets Route 70 at Ellisburg, a crowded signal that backs up at rush hour. Church Road and Haddonfield Road connect them. To the east, I-295 runs through the township, and its ramps at Route 38 and Route 70 mix highway speed with drivers hunting for an exit. The injuries that mean surgery and months of physical therapy tend to come from there.
NJ Transit buses run Route 38 and Route 70 and stop at the mall, so bus and pedestrian crashes are part of the picture, with a deadline of their own.
Serious Cherry Hill crashes go to Cooper University Hospital in Camden, the Level I trauma center for southern New Jersey. Lesser injuries often end up at Virtua Voorhees, just past the township line. Keep your discharge papers, because the insurer reads that first chart more carefully than anything you say later. If you skipped the emergency room, see a doctor when the pain shows up and say it started with the crash.
Under N.J.S.A. 39:6A-4, the PIP coverage on your own auto policy pays your medical bills regardless of fault, up to the medical limit you selected. PIP is not a claim for your pain. That depends on N.J.S.A. 39:6A-8: with the limitation on lawsuit option, the verbal threshold, you can only recover non economic damages for a displaced fracture, loss of a body part, significant scarring or disfigurement, a permanent injury confirmed by objective medical evidence, or death. The unlimited right to sue option has no threshold. Your declarations page tells us which you have.
A lawsuit over a Cherry Hill crash is filed in the Superior Court of New Jersey, Law Division, Camden County, at the Camden County Hall of Justice in Camden, and N.J.S.A. 2A:14-2 sets a two year deadline from the crash. There is a shorter clock too: if an NJ Transit bus, a township vehicle or any other public vehicle was involved, the Tort Claims Act, N.J.S.A. 59:8-8, requires a written notice of claim within 90 days, and without it the claim can be over before it begins. Fault is shared under N.J.S.A. 2A:15-5.1, so partial blame for a jughandle crash does not end your case if your share is not greater than the other side's.
