What controls how long an Alabama car accident case takes?

How long you treat, whether the insurer disputes fault, how much coverage exists, and the two year clock that forces a decision. No claim should settle before a physician can describe the lasting effect of the injury. A settlement releases the driver for good, and a knee that needs surgery a year after the crash cannot be added later.

Alabama's fault rule adds time of its own. Under contributory negligence, a jury finding that you were even slightly at fault can bar the claim, so adjusters raise shared fault in most files, and the demand cannot go out until the evidence answering it is in hand: the crash report, camera footage from businesses along the road, witness statements and vehicle data.

The two year deadline in Ala. Code 6-2-38 is the hard edge. If the claim has not settled as the second anniversary of the crash approaches, the complaint must be filed in the Circuit Court, and the case moves onto the court's calendar rather than the adjuster's.

What are the stages of an Alabama car accident claim?

Evidence and treatment fill the first months, a demand follows the end of care, negotiation runs a few months, then suit if needed.

Weeks one to four

The crash report is pulled from the Alabama Law Enforcement Agency or the city department that responded, footage requests go out before it is erased, witnesses are called, and every household policy is read for medical payments and uninsured or underinsured motorist coverage. If a city or county vehicle was involved, the sworn claim Alabama requires within months is prepared now.

Treatment, commonly three to twelve months

You follow the treatment plan, the chart grows, and the doctor orders imaging if symptoms do not fade. This stage ends when the physician can say what is permanent and what care remains.

Demand and negotiation, one to four months

We send the insurer a demand built from the medical chart, the bills, your employer's wage letter and the fault file. Alabama sets no deadline for an insurer to make an offer, and most respond in thirty to ninety days. Many claims settle here once the adjuster realizes the contributory negligence argument has nothing behind it.

Lawsuit, discovery and mediation, twelve to twenty four months

If the offer is inadequate or the two year date is near, the complaint is filed in the Circuit Court of the county where the crash happened or the defendant lives, for example Jefferson County Circuit Court for a crash on I-65 in Birmingham or Madison County Circuit Court for one on I-565 in Huntsville. Written discovery, depositions and, in most cases, mediation follow, and many filed cases end at or shortly after mediation.

Trial

Cases that do not settle are tried to a jury in that county, and the wait from filing to trial is often two years or longer.
