In Alabama, a Huntsville car accident claim is made against the driver who caused the crash, and there is no threshold to clear, but any fault on your side can wipe the claim out, so the early evidence decides everything. Top USA Law collects that evidence and handles every insurer. Call (877) 411-5291 for a free case review.

Where Huntsville car accidents happen

Huntsville traffic runs on a schedule set by Redstone Arsenal and Cummings Research Park, and the crashes follow the shift changes. I-565 carries the morning rush in from Madison and the western county, and the exits for Research Park Boulevard and the Arsenal gates back up onto the interstate, where a driver at highway speed meets a line of stopped cars. The evening rush reverses it, and the same rear end wrecks happen facing the other way.

Memorial Parkway, US 231, runs the length of the city with overpasses on some stretches and signalized crossings on others, and the change from one to the other catches drivers who expect free flow. University Drive, US 72, is a wall of shopping center entrances and left turns from Jordan Lane west toward Madison, and turning crashes there fill the emergency rooms every weekend.

Governors Drive climbs Monte Sano from the medical district around Huntsville Hospital, where ambulances, delivery trucks and commuters share a steep, curving road. Whitesburg Drive and Jordan Lane are older streets lined with driveways and bus stops, and pedestrians crossing to an Orbit stop are hit by drivers watching the car ahead instead of the crosswalk.

Getting treated at Huntsville Hospital

Huntsville Hospital on Governors Drive is the Level I trauma center, and the serious crashes from I-565 and the Parkway go there. Crestwood Medical Center off Whitesburg Drive treats many injuries from south Huntsville. The first emergency room record is what the adjuster reads first, because it shows what hurt before a lawyer was involved. If you walked away and felt it the next day, get examined then.

Paying for treatment without PIP

Alabama has no personal injury protection, so nothing is paid automatically. Health insurance covers treatment while the claim is open, and medical payments coverage on your own auto policy pays early bills whoever was at fault. The at fault driver's liability policy, which Ala. Code 32-7-6 requires on every registered vehicle, reimburses those costs together with lost wages and pain and suffering. We review your household's uninsured motorist coverage too.

Fault, the courthouse and the deadlines

Alabama's contributory negligence rule means that if an insurer can pin any share of the blame on you, the claim can fail entirely. So the case is built from early evidence: the Huntsville Police report for city streets or the ALEA trooper report for I-565, the dash and business cameras along University Drive, and the witnesses at the scene. We send preservation letters immediately.

A lawsuit is filed in the Circuit Court of Madison County at the Madison County Courthouse downtown. Ala. Code 6-2-38 gives you two years from the crash to file. If an Orbit bus or a City of Huntsville vehicle was involved, a sworn written claim must be filed with the clerk within a short period measured in months. A driver who left the scene broke Ala. Code 32-10-1, and a DUI charge under Ala. Code 32-5A-191 supports a wantonness claim that contributory negligence does not defeat.

Car Accidents questions in Huntsville

Which hospital treats Huntsville car accident victims?

Huntsville Hospital on Governors Drive is the Level I trauma center for north Alabama and receives the serious crashes from I-565 and Memorial Parkway. Crestwood Medical Center treats many injuries from south Huntsville. Top USA Law requests the records from whichever hospital saw you.

How do I get the police report for a Huntsville crash?

Huntsville Police write the report for crashes on city streets such as University Drive and the Parkway, and you request it through the department. Crashes on I-565 are often worked by ALEA troopers, and that report comes from ALEA. Get the report number at the scene.

Where is a Huntsville car accident lawsuit filed?

In the Circuit Court of Madison County at the Madison County Courthouse in downtown Huntsville. Ala. Code 6-2-38 requires the complaint to be filed within two years of the crash, and negotiating with the insurer does not extend that deadline.

I was hit by an Orbit bus. Is the claim different?

Yes. Orbit is Huntsville's public transit system, so a sworn written claim must be filed with the clerk within a short period measured in months before any lawsuit, and a late claim can end the case. The same rule covers any City of Huntsville vehicle.

Can I recover if I was partly at fault on I-565?

Usually not. Alabama follows contributory negligence, so an insurer that proves any fault on your side can deny the whole claim. That is why the ALEA report, dash camera footage and witnesses from an I-565 wreck come first. Do not discuss fault with the other insurer.

What does a Huntsville car accident lawyer cost?

Nothing up front. Top USA Law handles Huntsville crash cases on a contingency fee, so there is no attorney fee unless money is recovered for you. Case costs may apply and are set out in the written agreement before you sign. The consultation is free.
