In Alabama, a Birmingham truck accident claim runs against the trucking company and its insurer as well as the driver, but any fault pinned on you can bar the whole claim, so the truck's own data decides the case. Top USA Law preserves it before it disappears. Call (877) 411-5291.

Where Birmingham truck accidents happen

Birmingham is the point where Alabama's freight routes cross. I-65 runs the length of the state through the city, I-20 and I-59 share a roadbed through downtown, I-459 carries the through trucks around the southern suburbs, and all of them meet at the interchange drivers call Malfunction Junction. The loads move between the steel and pipe plants, the warehouse and trucking corridor along Finley Avenue and Daniel Payne Drive, the rail yards and the industrial ground along US 78 and US 31.

At Malfunction Junction the lanes are short and the weaving constant. A tractor trailer that cannot get across in time either sideswipes the car in the next lane or brakes hard and jackknifes, closing the interstate for hours. On I-459 the through trucks run at speed past the US 280 and I-65 exits, where a loaded semi cannot stop for braking traffic. On Finley Avenue the danger is a truck turning wide out of a terminal across cars and people on foot.

ALEA's commercial vehicle enforcement troopers inspect trucks after serious crashes, and because Alabama's contributory negligence rule can end a claim over any fault on your side, the trooper's findings are often the proof the case turns on.

UAB Hospital, the preservation letter and Alabama's rules

UAB Hospital is Birmingham's Level I trauma center and takes the serious truck crash injuries from I-65, I-20/59 and the west side. Get examined the same day even if you drove home, tell every provider a commercial truck was involved, and know that first record is the one every adjuster reads.

The same day preservation letter

A carrier's rapid response investigator may be at Malfunction Junction before the lanes reopen, and in a contributory negligence state the investigator's first project is you. The day you retain Top USA Law we send a written demand to the carrier, its insurer and the tow yard to preserve the engine control module data, electronic logging device records, driver facing camera footage, dispatch messages, the driver's qualification and drug testing file, inspection reports and maintenance records, much of which is overwritten within days once the tractor is repaired, and we obtain the ALEA post crash inspection report.

Fault, wantonness and the two year deadline

The Federal Motor Carrier Safety Regulations set the driver's hours, mandatory rest, drug and alcohol testing, driver qualification, inspection and maintenance. A violation is strong evidence of negligence, and a company that knew and ran the truck anyway may have acted wantonly. That distinction matters here: contributory negligence can bar an ordinary negligence claim if any fault lands on you, but it is not a defense to wantonness. Beyond the driver, the motor carrier, the trailer owner, the shipper that loaded the cargo and a maintenance contractor can each be liable with a policy far above the minimum Ala. Code 32-7-6 requires of a private driver.

Ala. Code 6-2-38 gives you two years from the crash to file, and a wrongful death claim has its own two year deadline from the death. Suit is filed in the Circuit Court of Jefferson County, Birmingham Division, or the Bessemer Division for the western county. A truck driver who kept going after a sideswipe violated Ala. Code 32-10-1, and a DUI charge under Ala. Code 32-5A-191 supports the wantonness claim. If a City of Birmingham truck or a MAX bus was involved, a sworn written claim must reach the clerk within a short period measured in months before any lawsuit, so we identify the owner at intake.

Truck Accidents questions in Birmingham

Why does contributory negligence matter so much in a Birmingham truck case?

Alabama can bar a claim entirely if any fault is placed on you, so the carrier's insurer looks for a slow merge or a moment in the truck's blind spot. The answer is the truck's own data, the ALEA inspection and witnesses, plus a wantonness claim, which contributory negligence does not defeat.

What does the preservation letter cover after a Birmingham truck accident?

The engine control module download, electronic logging device records, driver facing camera footage, dispatch messages, the driver's qualification and drug testing file, inspection reports and the maintenance history. Top USA Law sends the demand the day you retain the firm, because the carrier can overwrite that data within days.

Who can be liable for a truck crash on I-65 or Finley Avenue?

The driver, the motor carrier that dispatched the truck, the owner of a leased trailer, the shipper that loaded the cargo, a maintenance contractor and sometimes a freight broker. Each carries its own policy, and total coverage is what lets a catastrophic injury be valued fully.

How long do I have to sue after a Birmingham truck accident?

Two years from the crash under Ala. Code 6-2-38, filed in the Circuit Court of Jefferson County, and two years from a death for a wrongful death claim. A city truck or MAX bus requires a sworn written claim within months. The evidence deadline is days, so call before the tractor moves.

What is a wantonness claim and why does it matter here?

Wantonness means the carrier or driver knew the risk and ran the truck anyway: a driver dispatched past the federal hours limit, brakes the company knew were bad, or a DUI under Ala. Code 32-5A-191. Contributory negligence is not a defense to wantonness, and a wantonness finding opens the door to punitive damages.

What does a Birmingham truck accident lawyer cost?

Nothing up front. Top USA Law handles Birmingham truck cases on a contingency fee, so the consultation is free and there is no attorney fee unless we recover money for you. Case costs, such as data downloads, may apply and are explained in writing before you sign.
