In Alabama, a car accident settlement is worth the medical care the crash caused, the income it took, and the pain it left behind, with no threshold and no cap, limited by the insurance available and a fault rule that can erase the claim. Three things: what the crash cost you, how much insurance can be reached, and whether the other driver carries all of the fault. The first is the value of the case. The second is the ceiling. The third, in Alabama, is the switch: a strong claim pays nothing if a jury decides you contributed to the collision at all.
Alabama makes the first part simpler than most places. There is no no fault system, no personal injury protection and no injury threshold, so a claim against the at fault driver covers every category at once: medical bills paid or owed, future treatment your doctors expect, wages lost while you healed, reduced earning capacity if the injury is lasting, out of pocket costs, and the pain, limitation and lost enjoyment it caused. Alabama places no general cap on those damages.
The number is not a formula. Two people with the same diagnosis can hold claims of very different value depending on how long each treated, what the imaging shows, whether either can return to work, what policies exist, and how clean the fault evidence is. Any figure offered before those questions are answered is a guess.
Economic damages are proved with paper: every bill from the ambulance, the emergency department, imaging, specialists, surgery, therapy and prescriptions. Future care counts when a treating physician can describe it: a second surgery, hardware removal, years of injections. Lost wages come from pay records and a doctor's off work note. When the injury permanently changes what you can do, the claim includes the gap between what you earned before and what you can earn now. Vehicle damage is usually settled separately.
Non economic damages are the larger number in most serious Alabama cases and the hardest to prove. They cover pain, the activities you have given up, scarring, sleep, mood and the strain on a family. A jury in the county of the crash decides what those losses are worth, and settlements track what juries there have done with similar injuries. Past results do not guarantee a similar outcome.
Severity and permanence drive value more than anything else. A strain that resolves with therapy sits in one tier; a herniated disc with radiating symptoms and a lasting restriction sits well above it; a surgery moves the claim higher; a brain injury, spinal cord injury or death is valued against every policy that exists. Consistent treatment, objective imaging and a physician who will call the injury permanent add value. A late first visit, a missed month of therapy or a pre existing condition subtracts.
Insurance sets the ceiling. Ala. Code 32-7-6 requires liability coverage on every registered Alabama vehicle, but a minimum policy pays little for one seriously hurt person, so we read the other driver's policy, your underinsured motorist coverage, a resident relative's policy and any employer's policy first. Fault is the switch. Under Alabama's contributory negligence rule, a finding of even slight fault on your side can end the claim, so the crash report, camera footage and witnesses are part of the valuation.
