In Alabama, a Birmingham car accident claim goes straight against the driver who hit you, but any share of fault on your side can end it, so the evidence from the first days is the whole case. Top USA Law gathers that evidence and deals with every insurer while you heal. Call (877) 411-5291 for a free case review.
Birmingham's worst crashes cluster where three interstates cross downtown. I-20 and I-59 run together through the city and meet I-65 at the interchange everyone calls Malfunction Junction, where drivers weave across short lanes to reach the right exit and rear end collisions stack up in the afternoon backup. Trucks bound for I-65 keep hitting cars that slowed for the ramps, and one wreck there closes lanes for hours.
South of downtown, the Red Mountain Expressway carries US 31 and US 280 over the ridge, and once it becomes US 280 through Mountain Brook toward Inverness the road turns into a string of signals, left turns and driveways with heavy traffic at every hour. Sideswipes and chain reaction pileups there are a daily event, and I-459 around the southern suburbs adds high speed lane change wrecks near the US 280 and I-65 exits.
Inside the city, 1st Avenue North runs through downtown and Woodlawn past bus stops and crosswalks, and Finley Avenue on the west side carries truck traffic from the rail yards. Pedestrians and cyclists are hit on those streets when a turning driver looks for cars and not for people, and those injuries are often the worst we see.
UAB Hospital is the Level I trauma center where ambulances take serious crashes from the interstates and downtown, and Grandview Medical Center on US 280 near I-459 sees many injuries from Mountain Brook. That first emergency room chart is what every adjuster reads, because it records what hurt first. If your neck only stiffened up the next morning, get seen that day.
Alabama has no personal injury protection, so nothing is paid automatically. Health insurance covers treatment while the claim is pending, and medical payments coverage on your own auto policy pays early bills regardless of fault. The other driver's liability policy, which Ala. Code 32-7-6 requires on every registered vehicle, reimburses those costs at the end with lost wages and pain and suffering. We also check your household's uninsured motorist coverage.
Alabama follows contributory negligence: if the insurer can show you were even slightly at fault, the claim can be worth nothing. A Birmingham case is won or lost on evidence: the Birmingham Police report for city streets or the ALEA report for the interstates, camera footage from businesses along US 280, and the witnesses who stopped. We send preservation letters in the first week.
A lawsuit is filed in the Circuit Court of Jefferson County, Birmingham Division, at the Jefferson County Courthouse on Richard Arrington Jr. Boulevard, or in the Bessemer Division for the western county. Ala. Code 6-2-38 gives you two years from the crash to file. If a MAX bus or a city vehicle was involved, a sworn written claim must reach the clerk within a short period measured in months. A driver who fled violated Ala. Code 32-10-1, and a DUI charge under Ala. Code 32-5A-191 supports a wantonness claim that contributory negligence does not defeat.
