In Alabama, a Mobile car accident claim goes directly against the driver who caused the crash, with no threshold to clear, but the smallest share of fault on your side can end it, so the first days of evidence matter most. Top USA Law secures that evidence and handles every insurer. Call (877) 411-5291 for a free case review.

Where Mobile car accidents happen

Mobile's crashes start with the water. I-10 squeezes into the Wallace Tunnel under the river and then climbs onto the Bayway across Mobile Bay, and both are two lanes each way with nowhere to pull off. A stall or a fender bender at the tunnel mouth becomes a chain reaction within seconds, and fog on the Bayway has produced some of the largest pileups anyone here remembers. Port trucks headed for the I-65 interchange add weight and stopping distance to every one of those wrecks.

West of downtown, Airport Boulevard is the city's main commercial strip, with signals, shopping center entrances and left turns from I-65 out past the airport, and turning crashes there are the city's most common injury wreck. I-65 runs north from I-10 with short merges at Airport Boulevard, Springhill Avenue and Dauphin Street that produce sideswipes in the afternoon rush.

Downtown, Government Street carries US 90 past Government Plaza, Dauphin Street fills with pedestrians on weekend nights, and Water Street carries port truck traffic along the river. A pedestrian crossing Dauphin or a cyclist on Springhill Avenue is hit by a driver who never looked for anyone smaller than a car.

Getting treated at USA Health University Hospital in Mobile

USA Health University Hospital is the Level I trauma center, and the ambulances from the Bayway, the tunnel and I-65 go there. Mobile Infirmary near downtown and Providence Hospital off Airport Boulevard treat many other crash injuries. The first emergency room chart is what every adjuster reads, because it shows what hurt first. If the pain arrived the next morning, get examined that day.

Who pays the medical bills

Alabama has no personal injury protection. Your health insurance covers treatment while the claim is open, and medical payments coverage on your own auto policy pays early bills no matter who was at fault. The liability policy that Ala. Code 32-7-6 requires on the other driver's vehicle reimburses those costs at the end along with lost wages and pain and suffering. We review your household's uninsured motorist coverage as well.

Fault, Government Plaza and the deadlines

Alabama follows contributory negligence, so if an insurer can show you were even a little at fault, the claim can be denied entirely. That makes the evidence the case: the Mobile Police report for city streets or the ALEA report for I-10 and I-65, the cameras along Airport Boulevard and on the Bayway, and the witnesses. We send preservation letters in the first week.

A lawsuit is filed in the Circuit Court of Mobile County at Mobile Government Plaza on Government Street. Ala. Code 6-2-38 gives you two years from the crash to file. If a Wave Transit bus or a City of Mobile vehicle was involved, a sworn written claim must be filed with the clerk within a short period measured in months. A driver who left the scene violated Ala. Code 32-10-1, and a DUI charge under Ala. Code 32-5A-191 supports a wantonness claim that contributory negligence does not defeat.

Car Accidents questions in Mobile

Which hospital treats Mobile car accident victims?

USA Health University Hospital is Mobile's Level I trauma center and receives the serious crashes from I-10, the Bayway and I-65. Mobile Infirmary and Providence Hospital treat many other crash injuries. Top USA Law requests the records from whichever hospital treated you.

How do I get the police report for a Mobile crash?

If Mobile Police responded on a city street, request the report through the department. Crashes on I-10, the Bayway and I-65 are often worked by ALEA troopers, and that report comes from ALEA. Get the report number at the scene.

Where is a Mobile car accident lawsuit filed?

In the Circuit Court of Mobile County at Mobile Government Plaza on Government Street downtown. Ala. Code 6-2-38 requires the complaint to be filed within two years of the crash, and talking with the insurer does not pause that clock.

I was hit by a Wave Transit bus. Is the claim different?

Yes. The Wave Transit System is a public entity, so a sworn written claim must be filed with the clerk within a short period measured in months before any lawsuit, and a late claim can end the case. The same rule applies to a City of Mobile vehicle.

Can I recover if the insurer says I was partly at fault on the Bayway?

Usually not. Alabama follows contributory negligence, so proof of any fault on your side can bar the claim entirely. That is why the ALEA report, the traffic cameras and the witnesses from a Bayway pileup come first. Do not give the other insurer a recorded statement.

What does a Mobile car accident lawyer cost?

Nothing up front. Top USA Law takes Mobile crash cases on a contingency fee, so there is no attorney fee unless money is recovered for you. Case costs may apply and are explained in the written agreement before you sign. The consultation is free.
