In Alabama, a Montgomery car accident claim is paid by the at fault driver's liability insurer, and a single point of blame on your side can sink it, so the evidence from the first week carries the case. Top USA Law builds that record and answers every adjuster while you heal. Call (877) 411-5291 for a free case review.
Montgomery is where I-85 ends and I-65 keeps going, and their interchange beside downtown is the first place to look for a serious wreck. Traffic from Auburn and Atlanta merges on short ramps into the Birmingham to Mobile stream, and a truck braking late for the split starts a chain reaction. Farther south on I-65, the Hyundai plant at Hope Hull sends a shift change onto the interstate twice a day, and the pileups near the Southern Boulevard exits keep that schedule.
The Eastern Boulevard is the road Montgomery drivers dread. It carries US 231 past a wall of car dealerships, shopping centers and hotel driveways, and drivers turning left across it toward Atlanta Highway or Vaughn Road are hit broadside by through traffic that never slowed. Taylor Road and Vaughn Road are the east side's routes to the office parks and Auburn University at Montgomery, and their signals produce rear end wrecks every evening. Zelda Road is the older, driveway lined connector.
Downtown adds its own traffic: state employees heading to the Capitol complex, students at Alabama State University, and The M's buses on Dexter Avenue. Pedestrians there are struck by drivers hunting for parking, not watching the crosswalk.
Ambulances from the interstates and the Eastern Boulevard mostly run to Baptist Medical Center South, and Jackson Hospital takes many downtown crashes. The most severe injuries go to UAB Hospital in Birmingham, the nearest Level I trauma center. The intake note from that day is the adjuster's favorite document, because it fixes which injuries were reported first. Next morning soreness needs charting too, so go back in.
No PIP exists in Alabama, and there is no injury threshold. Your health plan pays the hospital during the claim, and MedPay on your own auto policy, if you bought it, covers early bills regardless of fault. The other driver's liability policy, required on every Alabama registration under Ala. Code 32-7-6, pays once, at the end, for the medical costs, missed paychecks and pain. We also check household uninsured motorist coverage.
Alabama is a contributory negligence state. An adjuster who can convince a Montgomery County jury that you were one percent responsible pays nothing, so the whole fight is over proof: the Montgomery Police report from a city street or the ALEA trooper report from I-65 or I-85, the dealership cameras along the Eastern Boulevard, event data from both cars, and the witnesses who stopped. We send preservation letters before the footage is overwritten.
If the insurer will not pay, we file in the Circuit Court of Montgomery County at the county courthouse on South Lawrence Street downtown, and Ala. Code 6-2-38 sets a two year clock from the crash date. A wrongful death case has its own two year limit. If one of The M's buses or another city vehicle hit you, a sworn written claim must be on file with the city clerk first, inside a short window measured in months, or the lawsuit is barred. A driver who fled broke Ala. Code 32-10-1, and a DUI arrest under Ala. Code 32-5A-191 lets us plead wantonness, which contributory negligence cannot block.

Top USA Law has no Montgomery office. We talk by phone or video, or come to your home or hospital room. In the first days we pull the crash report, put the at fault driver's insurer on written notice, and lock down Eastern Boulevard camera footage before it is erased. When one of The M's buses or a city vehicle is involved, the sworn claim is drafted first. The consultation is free and there is no fee unless we win, though case costs may apply. The Alabama car accident lawyer page covers the statewide rules, or call (877) 411-5291.
