In New York, someone injured in a Rochester crash has medical bills and a share of lost income paid by no fault coverage, with a separate case against the responsible driver for pain and suffering when the injury is serious. Top USA Law represents Rochester clients by phone, video, at home or at the hospital. Call (877) 411-5291.

Where Rochester car accidents happen

Rochester is ringed by expressways built for a larger city, and their speed is what hurts people. I-490 cuts straight through downtown, and the tight curves and short ramps where it meets I-590 at the Can of Worms interchange in Brighton produce rear end and lane change crashes daily. I-390 brings airport and Henrietta traffic into the same knot near the University of Rochester, and I-590 north toward Irondequoit meets Route 104, whose bridge over Irondequoit Bay ices before anything else in the county. The Inner Loop still circles part of downtown as a sunken road with blind merges even after the east side was filled in.

Surface streets carry the pedestrian and turning crashes. Lake Avenue runs from downtown to the beach at Charlotte past the old Kodak plant, with buses every few blocks. Monroe Avenue, East Avenue and Mount Hope Avenue mix hospital traffic, college students and delivery drivers at closely spaced lights. Snow off Lake Ontario outpaces the plows, and black ice on the 390 bridges surprises drivers every winter.

Rochester Police cover crashes inside the city, the State Police often take the expressways and the Thruway, and Top USA Law orders that report first.

Strong Memorial, no fault and the Hall of Justice

Strong Memorial Hospital on Elmwood Avenue is the Level I trauma center for Rochester and the Finger Lakes, and the worst 490 and 390 crashes go there. Rochester General on Portland Avenue treats many north and east side injuries. Give the emergency staff a complete account of what hurts; that chart is exhibit one for the insurer. If you were released at the scene, see a doctor within two days, since an untreated week reads as an uninjured week to an adjuster.

The no fault application and the 30 day clock

No fault coverage in New York comes from the policy on the vehicle you were in, or your own, and pays medical bills and part of lost wages without any fault finding, capped at 50,000 dollars of basic economic loss under Insurance Law 5102. The application is generally due within 30 days of the crash, and Insurance Law 5106 then requires payment within 30 days of proof of claim. A hit and run driver commits a crime under VTL 600, and a Rochester resident with no household coverage can turn to MVAIC.

Suing in Monroe County

Under Insurance Law 5104 you cannot sue the at fault driver for pain and suffering unless your injury is serious under Insurance Law 5102(d), which covers fractures, significant disfigurement, permanent or significant limitation of a body function, and permanent loss of use. The case is filed in the Supreme Court of the State of New York, Monroe County, at the Hall of Justice on Exchange Boulevard, within three years under CPLR 214. For lawsuits filed on or after May 26, 2026, CPLR 1411 applies modified comparative negligence to motor vehicle injury claims, so a driver who changed lanes late at the Can of Worms recovers minus their share unless their fault is greater than the other side's combined fault, which can bar the claim. RTS buses are run by a public authority, and a crash with one, or with a City of Rochester truck, requires a notice of claim within 90 days under General Municipal Law 50-e.

Car Accidents questions in Rochester

Which hospital treats serious Rochester car accident injuries?

Strong Memorial Hospital on Elmwood Avenue, part of the University of Rochester Medical Center, is the region's Level I trauma center, where the most severe expressway injuries go. Rochester General Hospital on Portland Avenue handles many north side and east side patients. Top USA Law obtains records from both.

Where is a Rochester car accident lawsuit filed?

In the Supreme Court of the State of New York, Monroe County, at the Hall of Justice on Exchange Boulevard in downtown Rochester. CPLR 214 allows three years from the crash to file, but business and intersection camera footage is usually overwritten within days, so evidence work cannot wait.

Which Rochester roads see the most serious crashes?

The Can of Worms, where I-490 and I-590 meet in Brighton, for merge and rear end wrecks; the I-390 bridges for black ice spinouts; the Inner Loop for blind merges; and Lake, Monroe, East and Mount Hope Avenues for pedestrian and left turn crashes at closely spaced lights.

An RTS bus was involved in my Rochester crash. What changes?

RTS is operated by a public authority, so General Municipal Law 50-e requires a notice of claim within 90 days of the crash, far ahead of the three year lawsuit deadline. The same rule covers City of Rochester plows and police vehicles. Botching that notice can end the case.

How do I get the police report for a Rochester crash?

The Rochester Police Department files the accident report for crashes inside the city. The New York State Police typically handle the Thruway and many expressway crashes, and suburbs like Greece and Brighton have their own departments. File your MV-104 within 10 days if anyone was hurt.

What does a Rochester car accident lawyer at Top USA Law cost?

There is no charge to talk with us, and Rochester cases are handled on contingency, so the attorney fee comes only out of money recovered. Costs may apply and are explained in writing first. We meet by phone, video, at home or at the hospital while you recover.
