In New York, a person hurt in a Syracuse crash collects medical and lost wage benefits from no fault insurance without proving fault, then holds the at fault driver responsible for pain and suffering if the injury is serious. Top USA Law works Syracuse cases by phone, video, at home or at the hospital. Call (877) 411-5291.

Where Syracuse car accidents happen

Syracuse sits at the crossing of two interstates, and the crossing itself is the problem. I-81 rides an aging viaduct straight through downtown past the hospitals and the university, with left hand exits, short merges and a stacked interchange with I-690. The viaduct project now moves lanes, closes ramps and shifts detours onto Almond Street and the surface grid, and each new pattern brings rear end crashes. I-690 carries the load east and west, and its I-481 interchange in DeWitt is where Thruway trucks and commuters meet at full speed. Late summer adds the New York State Fair, when the fairgrounds exits off I-690 in Geddes back up for hours.

Erie Boulevard was laid over the old canal bed and now runs as a strip of plazas with left turns across four lanes. Salina, James and Genesee Streets feed downtown, and pedestrians cross them at odd angles near the Centro hub on South Salina Street. Heavy lake effect snow arrives every winter, and whiteouts on 81 and 690 turn one stalled car into a pileup.

Syracuse Police handle city crashes, the State Police cover 81 and 690, and Top USA Law obtains that report first.

Upstate University Hospital, no fault and the courthouse on Montgomery Street

Upstate University Hospital on East Adams Street is the Level I trauma center for Central New York, and it sits beside the I-81 viaduct, so severe crash victims arrive fast. St. Joseph's Health on the North Side and Crouse on Irving Avenue treat many others. Tell the trauma team about every ache; that first chart shapes the insurer's view of your injuries. If you were not transported, get examined within two days instead of waiting for the pain to fade.

No fault benefits and the 30 day application

The no fault policy on the car you occupied, or your own auto policy, pays a Syracuse crash victim's medical bills and part of lost wages regardless of fault, up to the 50,000 dollar basic economic loss figure in Insurance Law 5102. The application is generally due within 30 days of the crash, and Insurance Law 5106 requires the insurer to pay within 30 days once it has proof of claim. Leaving the scene of an injury crash is a crime under VTL 600, and MVAIC can pay a Syracuse resident with no household coverage.

Filing suit in Onondaga County

To recover pain and suffering, Insurance Law 5104 requires a serious injury under Insurance Law 5102(d): a fracture, significant disfigurement, permanent or significant limitation of a body function, or permanent loss of use. The lawsuit is filed in the Supreme Court of the State of New York, Onondaga County, at the courthouse on Montgomery Street downtown, and CPLR 214 allows three years from the crash. For lawsuits filed on or after May 26, 2026, CPLR 1411 applies modified comparative negligence to motor vehicle injury claims, so a driver who followed too closely on an icy 690 recovers minus their share unless their fault is greater than the other side's combined fault, which can bar the claim. Centro is a public authority, so a crash with a Centro bus, or with a City of Syracuse plow or squad car, requires a notice of claim within 90 days under General Municipal Law 50-e.

Car Accidents questions in Syracuse

Where are serious Syracuse car accident injuries treated?

Upstate University Hospital on East Adams Street is the Level I trauma center for Central New York, where the most severe I-81 and I-690 injuries go. St. Joseph's Health on Prospect Avenue and Crouse Hospital on Irving Avenue treat many others. Top USA Law gathers records from whichever treated you.

Where is a Syracuse car accident lawsuit filed?

In the Supreme Court of the State of New York, Onondaga County, at the courthouse on Montgomery Street in downtown Syracuse. CPLR 214 sets a three year deadline from the crash, but construction zone cameras and witness contact information disappear quickly, so the investigation should begin within days.

Which Syracuse roads produce the most crashes?

The I-81 viaduct and its interchange with I-690 downtown, especially while the viaduct project shifts lanes; the I-690 and I-481 interchange in DeWitt; Erie Boulevard for left turns across plaza traffic; and Salina, James and Genesee Streets for pedestrian and intersection crashes. Lake effect snow makes all of them worse.

A Centro bus hit me in Syracuse. Does that change my deadline?

Yes. Centro is run by a public authority, so General Municipal Law 50-e requires a notice of claim within 90 days of the crash, far earlier than the three year lawsuit deadline. City of Syracuse vehicles trigger the same rule, and a late or incomplete notice can end the claim.

Who writes the police report for a Syracuse crash?

The Syracuse Police Department responds to crashes inside the city and files the accident report. The State Police generally handle I-81, I-690 and the Thruway, and the Onondaga County Sheriff covers many suburban roads. If anyone was injured, also file an MV-104 with the DMV within 10 days.

What does a Syracuse car accident lawyer at Top USA Law cost?

The consultation is free, and Syracuse cases are taken on contingency, so no attorney fee is owed unless the firm recovers money for you. Costs may apply and are explained in writing first. We work by phone, video, at home or at the hospital while you heal.
