Where St. Louis truck accidents happen

Five interstates converge on St. Louis and every one of them carries freight. I-70 comes in from the northwest, I-44 and I-64 from the west, I-55 from the south, and I-270 wraps the county so long haul rigs can bypass downtown. The loads are bound for the riverfront terminals, the Hall Street industrial corridor on the north side, the Earth City and Hazelwood warehouse districts near I-270, and the plants along North Broadway. Trucks run those routes at every hour, often at the end of a long shift.

The river crossings are where the trouble concentrates. On the approach to the Poplar Street Bridge the lanes from I-64, I-55 and I-44 merge inside a short distance, and a tractor trailer that cannot get over in time either forces a car into the wall or jackknifes across the lanes behind it. On I-270 the curves near the Missouri River bridges and the ramps at I-70 produce rollovers and sideswipes, and on I-44 through the south side the short exits put loaded semis next to commuters who have already stopped.

The Missouri State Highway Patrol's commercial vehicle enforcement troopers work the weigh stations on I-70 and I-44 and inspect trucks after serious crashes. Their reports often tell more than the driver does.

Barnes-Jewish, the preservation letter and Missouri's rules

The most serious truck crash injuries from I-70, I-64 and the north side go to Barnes-Jewish Hospital on Kingshighway, and those from I-44, I-55 and the south side go to SSM Health Saint Louis University Hospital on South Grand. The same day preservation letter

Carriers move quickly after a St. Louis crash, and an investigator may be photographing the bridge approach before the wreckage is cleared. Who is liable and what Missouri law requires

The Federal Motor Carrier Safety Regulations cap a driver's hours and require electronic logging, drug and alcohol testing, driver qualification files and documented inspection and maintenance; breaking one is strong evidence of negligence. Liability spreads beyond the driver to the motor carrier, the trailer owner, the shipper that loaded the freight in Earth City or Hazelwood and the contractor that serviced the brakes, each with a policy far larger than the minimum RSMo 303.025 requires of a private driver.

Missouri's pure comparative fault rule under RSMo 537.765 and Gustafson v. Benda reduces your recovery by your share and never bars it. RSMo 516.120 allows five years from the crash to file suit, and RSMo 537.100 allows a family three years from a death. A city crash is filed in the Circuit Court of the City of St. Louis; a county crash goes to the St. Louis County Circuit Court in Clayton. A driver who fled violated RSMo 577.060, and intoxication under RSMo 577.010 is admissible. If a city or state truck was involved, sovereign immunity applies with exceptions for the operation of motor vehicles and dangerous conditions of public property, and some cities require a short written notice, so we identify the owner at intake.
