In Missouri, a St. Louis car accident claim is made directly against the driver who caused the crash and that driver's liability insurer. There is no no fault layer to work through first, and being partly at fault reduces the claim rather than ending it. Top USA Law handles the insurer, the records and the court filing. Call (877) 411-5291.
Downtown St. Louis is where four interstates squeeze toward one river crossing. I-64 and US 40 come in from the west, I-44 and I-55 from the south and I-70 from the north, and they all funnel onto the approaches to the Poplar Street Bridge. The lanes split and merge inside a few hundred feet, and a driver who realizes late that the left lane is leaving for the bridge cuts across traffic that is already braking.
West of downtown, I-64 through the Central West End and past Forest Park carries hospital traffic, ballgame traffic and commuters at once, and the ramps at Kingshighway are short. I-44 along the south side has the same problem at Hampton Avenue, where ramp traffic meets trucks bound for the interchange.
The city streets have their own patterns. Kingshighway and Grand Boulevard run the length of the city with long signal cycles that tempt red light runners. Natural Bridge Avenue on the north side and Gravois Avenue on the south side are wide, fast and hard to cross on foot, and pedestrian injuries there are often the worst cases we see. Whatever the road, the evidence starts disappearing the same day.
Barnes-Jewish Hospital on Kingshighway in the Central West End is a Level I trauma center and receives the most serious crashes from I-64, I-70 and the north side. SSM Health Saint Louis University Hospital on South Grand is also Level I and takes much of the south side, including I-44 and Gravois. That first emergency chart is the document the insurer weighs most.
St. Louis Metropolitan Police write the report for crashes on city streets, and you request a copy through the department. On I-64, I-44, I-55 and I-70 the Missouri State Highway Patrol often responds instead. A lawsuit over a city crash is filed in the Circuit Court of the City of St. Louis at the Civil Courts Building on Market Street.
Missouri has no personal injury protection, so no part of your own policy pays medical bills automatically. Health insurance covers treatment while the claim is open, MedPay helps if your policy includes it, and the driver who caused the crash pays through the liability coverage RSMo 303.025 requires. Your own uninsured motorist coverage responds if that driver had none.
If you are blamed for part of a Poplar Street Bridge merge, RSMo 537.765 and Gustafson v. Benda reduce your recovery by that share and never eliminate it. RSMo 516.120 gives you five years from the crash to file suit, and RSMo 537.100 gives a family three years from a death. When a Metro Transit bus, a MetroLink train or a city vehicle is involved, sovereign immunity applies with exceptions for the operation of motor vehicles and dangerous conditions of public property, and some cities require a short written notice first. We send it first.
