In Missouri, a Columbia car accident claim is brought against the at fault driver and the liability insurer behind that driver, with no no fault claim in between. Being partly to blame trims the recovery but does not bar it. Top USA Law secures the crash report, the University Hospital chart and the camera video before it disappears. Call (877) 411-5291.

Where Columbia car accidents happen

Columbia sits on Interstate 70 midway between Kansas City and St. Louis, and its three exits carry most of the city's serious crashes. The Stadium Boulevard interchange on the west side dumps highway traffic into the retail strip around the mall, the Providence Road interchange feeds downtown and the campus, and US 63 splits off just east of it toward Jefferson City. Late lane changes for those exits, mixed with trucks on cruise control since the state line, make the mile between Providence and US 63 the worst stretch.

Inside the city the pattern changes. Providence Road and Stadium Boulevard are the two arterials everyone uses, and both are lined with signals, left turn lanes and shopping center driveways where a driver pulls out into a gap that is not there. Broadway downtown is slower but crowded, and Grindstone Parkway on the south side is a newer commercial strip with the same turning problems.

Then there is the University of Missouri. On a home football weekend the streets around Faurot Field fill with out of town drivers and pedestrians crossing mid block, and a Saturday night crash on College Avenue often involves a driver who had been drinking. Whatever the road, the video and the witnesses will not wait.

Getting treated at University Hospital after a Columbia crash

University of Missouri Health Care's University Hospital is the Level I trauma center for mid Missouri, so an ambulance leaving a bad crash on I-70 or US 63 is usually headed there. Boone Hospital Center on Broadway takes many of the rest. We request the records from either one right away, because the first emergency chart is what the adjuster uses to judge your injury.

The crash report and the Boone County courthouse

Columbia Police handle crashes on city streets, and their report comes through the department's records unit. On I-70 and US 63 the Missouri State Highway Patrol usually responds and keeps its own reports. If the case cannot settle, suit is filed in the Boone County Circuit Court at the courthouse in downtown Columbia, and a Boone County jury decides it.

Paying the bills, sharing fault and the five year deadline

Missouri does not have personal injury protection, so nothing on your own auto policy pays medical bills automatically. Your health plan covers treatment while the claim is pending, MedPay pays if it is on your policy, and the liability coverage every Missouri driver must carry under RSMo 303.025 ultimately pays for the crash. If the other driver had none, your uninsured motorist coverage takes that place. Leaving the scene violates RSMo 577.060 and driving while intoxicated violates RSMo 577.010, and either conviction helps the civil claim.

Missouri follows pure comparative fault under RSMo 537.765 and the Gustafson v. Benda decision, so an adjuster who says you rolled the stop sign on Grindstone can reduce what you get but cannot zero it out. RSMo 516.120 allows five years after the crash to bring an injury suit, and RSMo 537.100 gives a family three years after a death. If a Go COMO bus, a university vehicle or a city truck was involved, the public entity is immune except for the operation of a motor vehicle or a dangerous condition of its property, and some cities want a short written notice first, which we send first.

Car Accidents questions in Columbia

Which hospital treats Columbia car accident victims?

University Hospital, run by University of Missouri Health Care, is the region's Level I trauma center, and ambulances from I-70 and US 63 bring the most serious injuries there. Boone Hospital Center on Broadway treats many others. Top USA Law requests the emergency chart and follow up records from whichever one treated you.

How do I get the police report for a Columbia crash?

If the crash was on a city street, the Columbia Police Department wrote it and releases it through its records unit. On I-70 or US 63 the Missouri State Highway Patrol usually responded and releases its own reports. Tell us who responded and we track it down.

Where is a Columbia car accident lawsuit filed?

A Columbia crash case is filed in the Boone County Circuit Court at the courthouse in downtown Columbia. RSMo 516.120 gives five years from the crash to file, but the video from a business near Providence and Stadium is overwritten in weeks, so the investigation cannot wait.

I was hit by a Go COMO bus on Providence Road. Is my claim different?

Yes. Go COMO is run by the City of Columbia, a public entity, so sovereign immunity comes into play. Missouri carves out exceptions for a public employee operating a motor vehicle and for a dangerous condition of public property, and some cities also demand a short written notice early on. Call quickly so nothing is missed.

What if I was partly at fault for a crash on I-70 in Columbia?

You can still recover. Missouri uses pure comparative fault under RSMo 537.765 and Gustafson v. Benda, so your recovery is cut by your percentage of blame and nothing more. Someone found 30 percent responsible for a merge at the US 63 interchange still collects 70 percent. Let us speak to the other insurer first.

What does a Columbia car accident lawyer cost?

There is no upfront cost. Top USA Law represents Columbia crash victims on contingency: the consultation is free, and the attorney fee is a percentage of the recovery, owed only if we win. Case costs such as records fees may apply, and the written agreement spells them out before you sign.
