In Missouri, a Lee's Summit car accident claim runs against the driver at fault and that driver's liability insurer, and nothing has to go through your own policy first. Partial blame lowers the number but does not close the case. Top USA Law preserves the crash report, the hospital chart and the video while they still exist. Call (877) 411-5291.
US 50 is the spine of Lee's Summit, a freeway near I-470 that turns into a road with signals and cross traffic as it heads east past Missouri 291. Drivers leaving the freeway section are still at highway speed at the first signal, and a red light run there is a T-bone, not a fender bender. On the west edge, I-470 carries commuters north toward Independence and south toward Grandview, and the ramps where it meets US 50 and Douglas Street back up every evening.
Missouri 291 runs north and south through the middle of town, past the retail around Chipman Road and the older intersections near downtown, and left turns across two lanes go wrong there most often. Chipman Road is lined with driveways and turning conflicts from 291 out to Ward Road. Blue Parkway draws traffic to the shopping near I-470, and Missouri 150 along the south edge is fast and rural in stretches, with few streetlights and long response times after a rollover.
Douglas Street downtown is slower, but the crossings by the Amtrak station and the festival weekends put pedestrians in the street. Wherever it happened, the store cameras and the witnesses' memories will not last.
Lee's Summit has two hospitals, Lee's Summit Medical Center and Saint Luke's East Hospital, and an ambulance from US 50 or Chipman Road goes to one or the other. A head injury or internal bleeding usually means a transfer into Kansas City, where University Health Truman Medical Center and Research Medical Center hold Level I trauma status. Those records, starting with the emergency chart, are what an adjuster measures your claim against.
Lee's Summit Police write the report for crashes on city streets and release it through the records unit. On I-470 and the freeway portion of US 50 the Missouri State Highway Patrol often responds and keeps its own report. Lee's Summit sits in Jackson County, so a lawsuit goes to the Circuit Court of Jackson County at the eastern courthouse in Independence.
There is no personal injury protection in Missouri, so your own auto insurer is not obligated to pay the hospital first. Your health plan covers the treatment, MedPay chips in if your policy includes it, and the liability coverage RSMo 303.025 demands of every Missouri driver reimburses all of it. If the driver who hit you carried nothing, your uninsured motorist coverage steps in. A driver who was drunk at the Chipman Road signal broke RSMo 577.010, and we use that conviction.
Missouri applies pure comparative fault through RSMo 537.765 and Gustafson v. Benda: partial blame for a US 50 rear end crash shrinks the recovery by that percentage and nothing more. The deadline to sue is five years from the crash under RSMo 516.120, and three years from a death under RSMo 537.100. When a RideKC bus, a Lee's Summit R-7 school bus or a city truck is involved, sovereign immunity governs, with exceptions for a public employee driving a motor vehicle and for a dangerous condition of public property, and certain cities require a short written notice early, which we send immediately.
