In Missouri, a Kansas City car accident claim goes straight to the driver who hit you and that driver's insurance. There is no no fault step, and sharing blame lowers what you get but does not end the claim. Top USA Law builds the case from the crash report and the hospital chart. Call (877) 411-5291.
Interstate 70 runs through the heart of Kansas City, and the stretch east of downtown where it meets Bruce R. Watkins Drive, US 71, is where many of the city's serious crashes begin. Traffic off the Watkins ramps merges into fast lanes with little room, and the downtown loop just to the west stacks I-70, I-35 and I-670 on top of each other with exits on both sides. A driver who misses an exit and cuts across two lanes starts the chain reaction that fills the police log every rush hour.
The outer ring is no calmer. I-435 carries commuters around the whole metro, I-35 brings trucks in from the southwest, and I-29 feeds the airport and the Northland. A rear end crash at 70 miles an hour on I-435 is a different injury from the same crash at 30 on Ward Parkway, where the trouble is left turns across the median near the Plaza.
On the east side, Independence Avenue, Prospect Avenue and Troost Avenue see pedestrians struck at unlit crossings, and along Main Street the streetcar shares its lane with cars turning across the tracks. Each of those crashes leaves evidence that fades within days.
University Health Truman Medical Center on Hospital Hill is a Level I trauma center and where ambulances take the worst crashes from I-70 and the downtown loop. Research Medical Center on Meyer Boulevard is also Level I, and Saint Luke's Hospital sits near the Plaza. That first emergency chart is the record the insurer trusts most.
Kansas City Police write the report for city street crashes, and you request it through the department's records unit. On I-70, I-435, I-35 and I-29 the Missouri State Highway Patrol usually responds. A lawsuit over a Kansas City crash is filed in the Circuit Court of Jackson County, which sits at the downtown courthouse on East 12th Street and at the courthouse in Independence.
Missouri has no personal injury protection, so nothing on your own policy pays medical bills automatically. Health insurance covers treatment while the claim is open, MedPay helps if you bought it, and the driver who caused the crash pays through the liability coverage that RSMo 303.025 requires of every Missouri driver. If that driver had none, your own uninsured motorist coverage responds.
If you were partly at fault for a merge at the Watkins interchange, RSMo 537.765 and Gustafson v. Benda mean your recovery is reduced by your share, not wiped out. RSMo 516.120 gives you five years from the crash to file suit, and RSMo 537.100 gives a family three years after a death. A RideKC bus, the streetcar or a city truck adds a step: public entities have sovereign immunity except for the operation of motor vehicles and dangerous conditions of public property, and some cities require a short written notice first, so we send that notice first.
