In Missouri, an Independence car accident claim is made against the driver who caused the crash and the insurance company standing behind that driver. There is no no fault stage first, and a share of the blame reduces your recovery without ending it. Top USA Law locks down the police report, the Centerpoint records and the video before they disappear. Call (877) 411-5291.

Where Independence car accidents happen

Interstate 70 cuts across the south half of Independence, and its two busiest exits are where the city's worst wrecks pile up. The Noland Road interchange drops highway traffic onto the busiest commercial street in town, and the 291 Highway interchange a little east of it mixes trucks bound for Lee's Summit and Liberty with commuters heading downtown. Drivers who realize late that they need a ramp cut across lanes, and those crashes happen at highway speed.

Off the interstate, Noland Road is the street that comes up most. It runs north from I-70 past dealerships, fast food and the shopping near 39th Street, with a driveway or signal every block and a center turn lane drivers treat as a merge lane. 23rd Street crosses it and has the same problem from Sterling Avenue to Lee's Summit Road. On the north side US 24 carries traffic past the Truman Library and west toward Sugar Creek, and the Truman Road corridor through the older neighborhoods has narrow lanes, parked cars and pedestrians stepping out between them.

US 40 along the southern edge is faster and darker, and a rear end crash there at night is nothing like a fender bender in the Independence Center parking lot. Either way, the video and the witnesses will not keep.

Getting treated at Centerpoint after an Independence crash

Centerpoint Medical Center, off I-70 at Little Blue Parkway, is the hospital nearest most Independence crashes, and an ambulance from Noland Road usually stops there. The most severe injuries go west to University Health Truman Medical Center in Kansas City, the region's Level I trauma center. Either way, that first emergency chart becomes the backbone of the claim, and we request it the day you hire us.

The crash report and the Independence courthouse

The Independence Police Department writes the report for crashes on city streets and releases it through its records division. I-70 wrecks are often worked by the Missouri State Highway Patrol instead, and the Patrol keeps those. Eastern Jackson County has its own courthouse, so an Independence lawsuit is filed in the Circuit Court of Jackson County at the Independence courthouse rather than downtown Kansas City.

Insurance, shared fault and the time limit to sue

Because Missouri has no personal injury protection, your own auto policy does not automatically pay the hospital. Treatment runs through your health insurance while the claim is open, MedPay pays if you added it, and the bill lands on the liability policy that RSMo 303.025 makes every Missouri driver carry. When the other driver had no policy, or fled, your uninsured motorist coverage answers, and a hit and run violates RSMo 577.060, which strengthens the civil case once the driver is found.

Fault is shared, not all or nothing. Under RSMo 537.765 and Gustafson v. Benda, being 20 percent responsible for a lane change at Noland Road means recovering 80 percent, never zero. RSMo 516.120 sets a five year deadline to file an injury suit and RSMo 537.100 a three year deadline after a death. An IndeBus, a RideKC bus or a city truck brings sovereign immunity into the case, with exceptions when a public employee was driving or a dangerous condition of public property caused the harm, and a few cities also demand a short written notice up front, which we send first.

Car Accidents questions in Independence

Which hospital treats Independence car accident victims?

Centerpoint Medical Center, off I-70 at Little Blue Parkway, receives most Independence crash patients. The worst injuries are taken to University Health Truman Medical Center in Kansas City, the Level I trauma center for the metro. Top USA Law requests the emergency chart and follow up records from whichever hospital cared for you.

How do I get the police report for an Independence crash?

For a crash on a city street such as Noland Road or 23rd Street, the Independence Police Department has it and releases it through its records division. For I-70, the Missouri State Highway Patrol may have responded, and you request that report from the Patrol. We order it for you.

Where is an Independence car accident lawsuit filed?

In the Circuit Court of Jackson County at the eastern Jackson County courthouse in Independence. RSMo 516.120 allows five years from the crash to file, but the dealership cameras along Noland Road overwrite themselves in weeks, so we start long before that.

I was hit by an IndeBus on 23rd Street. Is my claim different?

Yes. IndeBus is the city's transit service, so the City of Independence, a public entity, is the defendant. Sovereign immunity applies, with exceptions for a public employee operating a vehicle and for a dangerous condition of public property, and some cities insist on a short written notice early. Call soon so it goes out on time.

What if I was partly at fault for a crash at the 291 Highway interchange?

You still have a case. Missouri's pure comparative fault rule, RSMo 537.765 as shaped by Gustafson v. Benda, reduces your recovery by your share of the blame and stops there. A driver held 35 percent responsible still collects 65 percent. Let us handle the adjuster's questions.

What does an Independence car accident lawyer cost?

Nothing to start. Top USA Law takes Independence crash cases on a contingency basis, so the consultation is free and the attorney fee comes out of the recovery only if we win. Case costs can apply, and the written agreement lists them before you sign anything.
