In Missouri, a Springfield car accident claim is filed directly against the driver who caused the crash and that driver's insurance company. No no fault step comes first, and sharing part of the blame lowers the recovery without ending it. Top USA Law gathers the police report, the hospital records and the camera footage before they disappear. Call (877) 411-5291.

Where Springfield car accidents happen

Springfield's worst crashes happen on the highways that box the city in. I-44 runs along the north side with a steady line of trucks crossing the state, and its interchange with US 65 on the northeast corner mixes that truck traffic with local drivers heading for Kearney Street. US 65 down the east side is fast and elevated, and US 60, the James River Freeway, wraps the south side, where drivers coming off Battlefield Road and Campbell Avenue merge at highway speed.

Inside the city, Glenstone Avenue is the road that shows up most in our intake. It is a wide commercial strip of shops and driveways from Kearney to Battlefield, and a car pulling out of a parking lot into the center turn lane is the classic Springfield crash. Sunshine Street and Battlefield Road have the same problem near the malls, and National Avenue by Missouri State University sees students crossing between signals.

Kearney Street on the north side is wide and dark in stretches, and pedestrians hurt there are often the most seriously injured people who call us. Wherever in Springfield you were hurt, the store cameras and the witnesses are gone within days.

Getting treated at Mercy or Cox South after a Springfield crash

Springfield has two Level I trauma centers, Mercy Hospital Springfield near National Avenue and CoxHealth Cox South on South National, and ambulances from I-44, US 65 and the James River Freeway go to one of them. That emergency chart is the record the insurer reads most closely.

The crash report and the Greene County courthouse

Springfield Police write the report for crashes inside the city, and you request it through the department's records section. Crashes on I-44 are usually worked by the Missouri State Highway Patrol. A lawsuit over a Springfield crash is filed in the Greene County Circuit Court at the Greene County Judicial Courts Facility on North Boonville Avenue.

Who pays, shared fault and the five year deadline

Missouri has no personal injury protection, so your own policy does not pay medical bills automatically. Health insurance covers treatment while the claim is open, MedPay helps if you chose it, and the driver who caused the crash pays through the liability coverage that RSMo 303.025 requires of every Missouri driver. Your own uninsured motorist coverage responds if that driver had none or drove off, and leaving the scene is a crime under RSMo 577.060.

If the adjuster says you pulled out too soon on Glenstone, RSMo 537.765 and Gustafson v. Benda mean your recovery is cut by your share of fault and never erased. RSMo 516.120 gives you five years from the crash to file suit, and RSMo 537.100 gives a family three years from a death. A City Utilities Transit bus or a city truck brings in sovereign immunity, with exceptions for the operation of motor vehicles and dangerous conditions of public property, and some cities require a short written notice up front. We send that notice first.

Car Accidents questions in Springfield

Which hospital treats Springfield car accident victims?

Mercy Hospital Springfield and CoxHealth Cox South are both Level I trauma centers, and ambulances from I-44, US 65 and the James River Freeway go to one or the other. Top USA Law requests the emergency records from whichever hospital treated you, along with any follow up care.

How do I get the police report for a Springfield crash?

For a crash on a city street, request the report from the Springfield Police Department's records section. For a crash on I-44, the Missouri State Highway Patrol usually wrote it, and you request it from the Patrol. If you are not sure who responded, we find out for you.

Where is a Springfield car accident lawsuit filed?

In the Greene County Circuit Court at the Greene County Judicial Courts Facility on North Boonville Avenue. Under RSMo 516.120 the lawsuit must be filed within five years of the crash, but the footage and witness memories that decide it fade within weeks.

I was hit by a City Utilities Transit bus on Kearney Street. Is my claim different?

Yes. City Utilities Transit is a public entity, so sovereign immunity applies with exceptions for the operation of motor vehicles and dangerous conditions of public property, and some cities require a short written notice first. Call early so the notice goes out on time.

What if I was partly at fault for a crash on Glenstone Avenue?

You still have a claim. Under RSMo 537.765 and Gustafson v. Benda, your recovery is reduced by your share of fault but never eliminated. A driver found 20 percent at fault recovers 80 percent. Do not give the other insurer a recorded statement first.

What does a Springfield car accident lawyer cost?

Nothing up front. Top USA Law takes Springfield crash cases on a contingency fee, so the consultation is free and there is no attorney fee unless we recover money for you. Case costs may apply, and the written fee agreement explains them before you sign.
