In Washington, D.C., a truck accident claim is decided by fault. New York Avenue NE is the District's main truck corridor, bringing tractor trailers in from the east and dropping them onto Florida Avenue NE, where the Union Market and Ivy City warehouses load and unload all day. South of the Capitol, I-395 and the Southeast Southwest Freeway carry through trucks to the 11th Street Bridge and I-295, and South Capitol Street funnels heavy vehicles past the ballpark and across the Anacostia River.
East of the river, Benning Road NE carries garbage trucks to and from the Benning Road transfer station, and the Fort Totten transfer station draws the same traffic through Northeast. Downtown the trucks are smaller but closer: delivery trucks double parked in the travel lane on K Street and Connecticut Avenue, dump trucks leaving construction sites, and box trucks turning across crosswalks where the District's pedestrian and bicycle traffic is heaviest.
There is a legal twist. Because a driver or passenger who shares even a small part of the blame can be barred from recovering, the carrier's insurer will hunt for any lapse on your side. Your case rests on showing the truck driver alone caused the crash, and that proof lives in the carrier's own records.
A serious truck injury in the District is treated at MedStar Washington Hospital Center on Irving Street NW or George Washington University Hospital in Foggy Bottom, both Level I trauma centers, or at Howard University Hospital. The Metropolitan Police Department writes the crash report, and in a crash with life threatening injuries the Major Crash Investigations Unit builds a separate file with measurements.
A carrier's response team can reach a crash on New York Avenue within hours. Code 31-2404, accepting them limits your right to sue for a period, so we read the policy first.
A District truck accident lawsuit goes to the Superior Court of the District of Columbia, Civil Division, at 500 Indiana Avenue NW within three years under D.C. Code 12-301, or within two years of a death under D.C. Code 16-2702. A Department of Public Works garbage truck or any other District vehicle means a written notice to the Mayor inside six months under D.C. Code 12-309. A Metrobus is a claim against WMATA, which has its own claim process.
